Must One Be Spain Resident To Register COM.ES?

If I want to target Spanish market but live outside of country, am I free to register COM.ES domain or there are rules I need to adhere such as being resident, have business in Spain etc.? I am not sure if this document is updated but from reading it, I think they confused 3rd level domain with second.

Also how would domain with COM.ES extension perform to generic TLDs like .COM .NET .ORG? Would it be better to cater to Spanish market non-SEO and SEO wise?

And regarding legal stuff like Privacy Policy, Disclaimer, Affiliate Disclosure. Would it need to be in compliance with Spain laws and accustomed accordingly when promoting affiliate product?
