The use of the word bay

Hey do you think it is acceptable to use the word bay in your domain, for example somethingbay.com

I know pirate bay have done but they aren't exactly an ethical company and don't use the .com tld. If you was to do this would you be infringeing on eBay's trademark and expect to be shut down?

well its not an auction site and its in a different niche all together the two couldn't be thought of as competitors

If it's an ebay affiliate site it's probably a bad idea. If it has nothing to do with ebay, who cares, do whatever you want.
