Outrageous adsense placement or not?

Is the adsense placement on forbes.com 's opening page even allowed under adsense TOS. (Clearly not my site but forbes the business people's) You will need to view it to see what I mean,but basically it displays one 300x250 top and center on a black background before allowing you to reach any page on the site (Note it only does this the first time each day you visit it.
It seems a somewhat outrageous placement and I can't see how such a large prominent website is getting away with it, or how, as I'm sure they'd bust me if I did it...

    Forbes doesn't run regular Adsense, large sites like that have accounts where they can custom build Ad blocks.

      I'll tell you what...if google let even some good adsense sites in
      on that stuff, man, we'd be millionaires. I aint kidding. To
      be able to create custom ads, complete with YOUR FRIGGIN
      keywords, and not some crapshoot from the adsensebot,
      holy cow....break every tos rule for the little guy....boy
      oh boy...that kind of talk always has me salivating....

      But I do understand why the bar is so high.

      Of course I can't understand why anyone is selling adsense
      secrets, and did not know about google partners....and the
      different rules they get to play under...
