How Many Words or Characters Until Content is Considered Duplicate Within the Same Website?

For some reason I am convinced that duplicate content penalty is true if it's within the same website (from observations in my own sites). Now my question is, how many words or characters is considered duplicate content in a site?

For example, headers and footers could have some substantial content that is duplicated in the entire website like current promos, business address, contact info, copyright info, etc. How do you actually determine whether what you put in your header or footer is safe from duplicate content penalty? Or I am just over analyzing this?

    In most cases, it's not a penalty but a filter. The most relevant page for a particular search is shown in search results.

    For example, let's say I have a WordPress niche blog about ties called supercheaptieworld.com. I have a post titled 'cheap brightly colored ties' that has several tags like 'orange ties', 'neon green ties', etc. Each tag points to technically a duplicate page. When a Google searcher types in 'cheap brightly colored ties' they may get my post page but if they type in 'cheap orange ties' they may get the tag page and my actual post page won't show in results. It's a matter of what's keyword relevant to a specific search.

    Google does realize that many CMS systems produce duplicate pages so they are slow to penalize a site for this. Instead, they just filter out non-relevant results. You could get a penalty if your site was obviously spamming keywords. For example, if you put a 'Britney Spears' tag and tons of other non-relevant tags on your post about ties this might give you trouble.

    Google introduced the canonical attribute earlier this year but it has yet to see widespread use. If you're really worried about on-site duplicate content use this to take care of it. However, I haven't seen this as a major issue on my sites.

    On my opinion all the text should have more that 30% of difference. It not depend on where it is in header or footer. Search engines crawlers are really clever, i know..

    Just make sure each page has a unique title and unique content within the body. As for other template elements, I wouldn't worry too much.

    I have though written a bit of code that alternates some template links throughout my siites. This has helped my rankings for my main keywords and splits the link density between 3 phrases rather than just one.

    As far as the same site is concerned, it seems the content has to be at least 30% different to stay out of the filter. In most cases search engines like Google will just drop anything that looks duplicated and keep whatever seems relevant.
