Conditions of my ownership of a facebook fan page I created for someone else company

Hi all,

I have just created a facebook fan page in order to promote a local business I don't own.

However, I would like to know under which conditions I will still have the ownership of this fan page (in order to avoid issues described here ).

    You never own your facebook page. Facebook always owns the page and can lock it or take it down at any time.

    The only thing you can do is manage and maintain the page within facebook's ToS.

    You won't have the problems from the article because it is a different situation than yours. TV shows are produced and owned by production and media companies.

    This ruling relates to the rights to the TV show. If you create a page for a trademarked or copyright product that you do not have the rights to, then you can hardly stake an ownership claim to the intellectual property.

    In other words, if you do not own the rights to what you are posting about, you cannot claim a proprietary interest.

      Yes, but it is a fan page so I thought normally any fan should be able to create a facebook fan page in order to promote their favorite local business/brand (even they don't own this last).

        You can most likely create a fanpage as long as you don't pretend to be the original entity. If you got paid to do this, it is work for hire and you do not own it. Facebook really owns, so the business does not own it either, but you do not have ownership of it at all.

          In fact, I am not paid for the creation of the fan page but only on commission (lead) according to the number of person I will lead to buy something in the business.

            If you were directed to create the page as a part of your promotion and got paid for promoting, it is still work for hire. If it is up to you as to how you promote the club, it is more of a grey area. If you are hired for results only and how you get them is up to you, then it sounds like you should be able to claim nominal ownership of the page.

            This still depends on whether your client wants to give a problem or not. I suspect you are going to be better off, creating a more general page and posting about your client's club on that page.

    I don't think you can ever own something in someone else's name.
    It's like me creating a page for Brad Pitt and getting thousands and thousands of followers because of HIS name and HIS reputation.
    But I am not Brad Pitt.
