Quick question: you say in the video that as one of the few conditional restrictions, the magazines that warriors create cannot be sold on the Warrior Forums. Can you clarify that you only mean they can't literally be sold here, meaning that the $ transaction can't be done from the site---surely you don't mean that it can't even be promoted here, right? Could I not have things like sig links and paid ads here, etc that promote it, but sell it offsite?

Edit: sorry, I have another question too. I'm a little unsure about your use of the word "or" in a few places in your original post. For example, in one spot you say buyers can be the editor, OR sell the magazine for a profit. Surely that doesn't mean these things are mutually exclusive? I for one would want to do both, without a doubt.

To answer your last question first. Yes, you can do both. You can sell the magazine AND be the editor.

At the moment, we have a blanket ban on promoting the PLR magazine on the Warrior forum while this wso is open. We may change this in future and allow sig links etc. as I see that as okay - but selling the mag in a wso will definitely never be allowed.

So I purchased this WSO in December (and also purchased the Offline Magazine PLR shortly after it launched in January).

I didn't have time to get around to doing anything with it until only recently - when I started to work on making some improvements to the December issue - but quickly realized that there seemed to be a serious problem with the Website Magazine product.

The problem was that the content - at least for the Dec edition - was made up of a lot of articles from Ezinearticles.com, which, as everyone probably knows, has quite a few conditions around the republication of its content - notably (following is quoted directly from EZA terms of service, which you can see here: http://ezinearticles.com/terms-of-service.htm):

If you wish to publish/reprint any article from our site in your ezine, website, blog, forum, RSS feed or print publication, you must:
  • Respect the copyrights of the authors by publishing the entire article as it is with no changes.
  • Agree to include the FULL Resource box or SIG line at the end of the article.
  • Agree not to change the title or content of the article in any way.
  • Agree to make all links so that they are Active/Linkable with no syntax changes.
  • Agree to include the article source credit below each article reprinted with the link active
  • Agree to never sell any article from the EzineArticles.com directory.
  • Agree to never charge others to view any article you reprint from our directory.
  • Agree to never reprint any author photo or images found on our site.
Now I had no idea that some/most of the content was simply copied from EZA. I had now way of knowing this and only found out when I was copying/pasting content from the source .doc files to an Adobe InDesign template, so that I could tweak the look and feel of it.

References to EZA that were not visible in the source.doc files - they were just outside of the viewable portion of the .doc text frame - jumped out at me in InDesign.

Anyway, I then checked on most of the rest of the content and found that the majority of it was from EZA.

And even though I wouldn't have purchased the product if I had known it had been copied from EZA, it wouldn't be so bad if it were at least compliant with EZA's terms of service.

But it's not - not by a long-shot.

And even if it were made compliant - which is what I had thought about doing (filling out full resource box information in each of the articles from EZA and removing any photos that had been lifted off the EZA site) - there are still a couple of problems (one of which is a deal-breaker):
  • You're not allowed to make any changes to the articles (this is the deal-breaker, as some of the content definitely needs some work, in my opinion)
  • You're not allowed to sell any article (I assume that this would extend to selling a publication with EZA articles in it) - but not an issue if you're giving away for free
  • You're not allowed to charge others to view any article you reprint from the EZA directory - also not an issue if you're giving away for free
Moreover, there are other articles that have been copied from sources such as Searchengineland.com and About.com.

Anyway, I raised a high-priority support ticket with the Help Desk, expressing my concerns, and when I hadn't heard back in about 48 hours (in spite of a stated response time of 12-24 hours), I sent them another message (yesterday).

I still haven't heard anything.

I also raised a high-priority support ticket (yesterday morning) with the affiliate whose link I made my purchase through, advising him of my concerns and asking for a full refund.

I haven't heard anything from him yet, either (although I did just receive an email from him promoting another WSO...lol).

Maybe some clarification and an explanation can be provided here (and a refund to the PayPal account I purchased through).

Well thats enough for me. Thanks for pointing all of this out Treesa. I myself didn't like the fact that the magazine content itself is really inferior quality for print, which was my goal to have a real print magazine not a digital one.

Then I find out that the content is not allowed to be used as advertised? Calling it quits. Please refund. My Paypal Transaction ID # 8LK36781F0464705H

For what it's worth, as of this writing, I still haven't had any response from either Warrior's Help Desk.

UPDATE:

I still haven't heard back from the product creator - not holding out much hope at this point - but did get a response - and an immediate refund - from the affiliate whose link I purchased one of the subscriptions through.

I take this very seriously and am currently undertaking a full investigation into the breakdown in process for the December issue. I believe that we own rights to ALL articles we use in our magazines. Having said that, I'm not sure why EZA would be referenced, that is what I am investigating and will rectify immediately should I find we have made an error on our end.

Our business model is to use articles supplied by contributors, as well as members of our site. It is the magazine design itself that is PLR, we supply the articles as part of the design as contributed by our members and contributors, and in some cases (especially earlier issues when we were just getting going) high quality PLR articles that we have purchased the full rights to. You can also add your own articles and content to the design. I can understand your shock, I was shocked also, and that is why I am addressing this and will investigate fully and remedy the situation. Happy to refund you if you don't want to continue, and your refund has been processed.

A lot of time and effort goes into producing each monthly issue of our magazine. This involves a lot of people from designers, editors, admin staff, contributers etc. Please bear with us as we work through this issue for you. We remain dedicated to producing a high quality monthly magazine for our readers, members and their readers. We rely on the contribution of content from our contributors, and our members and believe we will continue to grown and be the best possible resource for everyone involved.

Your response is unsatisfactory.

First, the issue I raised is not isolated to the December issue. All issues appear to use content from Ezinearticles - and other sources that appear to copyright their content - going back to the first issue in June all the way up to the most recent issue in January.

Second, you say that you're not sure why Ezinearticles was referenced and yet you were clearly aware of this - as the following exchange in this thread shows:

Question from a forum member in post 119: "I want to subscribe but the eZine articles in the magazine are holding me back. Did you make an agreement to use their articles and bypass the TOS? And does it allow us to do the same?"

Your reply in post 121: "Yes, and most content in future issues will be from members."

I doubt that Ezinearticles makes special exceptions.

Third, to say that you "believe" you own rights to all of the articles isn't good enough. You have to know this, especially since you are potentially opening people up to legal liability over copyright violations (to say nothing of the damage it could do to their reputations).

Here's what Ezinearticles says about violations of their TOS (from: http://ezinearticles.com/terms-of-service.html):

"If you violate any of the above terms of service and/or any author copyright when reprinting articles from our site, you agree to be held liable for all attorney fees and statutory damages awarded upon a copyright infringement lawsuit that may be brought against you. Please read Section 504(c)(2) (U.S. Copyright Office - Copyright Law: Chapter 5). You agree that any legal proceedings against you will occur in Brown County in the State of Wisconsin, USA."

Fourth, the issue goes beyond Ezinearticles. There's content from About.com, Searchengineland.com, as well as published books.

Finally, on a separate but related note, when you drill down into the quality of the content, you see that it leaves a lot to be desired.

Here are just four examples:
  • The January issue recycles an article on Tribe Pro from the December issue - word for word - except, strangely, under a different author name, different title, and with a different graphic treatment
  • The December issue recycles a news piece from the November issue (US Mobile Social Media Audience up 37% in 2011)
  • The January issue features a "back story" on Sam Walton, who died in 1992, so it's neither timely nor relevant to the subject of Internet marketing
  • The December issue features a "success story" on Pink Cake Box that's taken from a 2008 article in Searchengineland - also not exactly timely
There are many more examples of poor quality and sloppiness, but I won't go on about them - other than to say that it was actually my concerns over the quality of the content that caused me to invest a lot of time in editing the magazines which is how I found out that there were multiple potential copyright issues with the articles.

I haven't bothered checking out the Offline magazine (which I also purchased), but think it's reasonable to assume that the situation is the same with it (and, I'm guessing, the same might be true of the other magazines you publish).

I have requested a refund from you for the Offline magazine - which you say has been processed, but, as of this writing, I have not received it.

I'm a little surprised because the affiliate who I purchased the Website magazine through refunded my purchase immediately.

You have all of the details necessary so please simply refund my purchase.

A couple of other suggestions that would go a long way towards making this right:
  • I think you should proactively notify everyone you sold this magazine to and inform them about the situation, because, as mentioned, I think that they may face some legal liability for the publication and distribution of the Website magazine (and possibly the others, if the circumstances are the same)
  • I think you should refund everyone's money because it appears that the product cannot be legally used as advertised
  • I think that you should do the same with the other magazines if the circumstances are the same
I think I've said enough.
