How would you protect a web design you outsource?

I have a website project that I am thinking of either writing myself or perhaps outsourcing it and getting it written by a professional programmer.

I have a concern if I outsource it though - my idea is easily copy-able and I'm worried it may get stolen if I outsource it. All my ideas for the website have to be passed onto the programmer, at which point the programmer could keep my ideas and implement them on his own after my job is complete.

How do I protect my website intellectual property from theft when outsourcing?

    Hi IMil,

    Wots to stop someone copying the design as soon as you make the website go live. Its an easy thing to do if you have the right tools.

    It comes down to how much trust you have in the programmer, graphic designer and web people you have working for you.

    Even if you get them to sign a document of sorts, it is worthless if they are outside of Oz. As Australian law doesn't cover them..

      Yes there's a way, though it all depends on what you want to protect and
      at what price.

      The content, the graphics, an special idea, a process?

      As for "protecting" a site you get developed by outsourcing of course the
      person who develop the thing for you has it all on hand, and like Bruce
      said, and even if you make them sign a document of some sort you can
      never know. It's a matter of trust, indeed.

      Maybe have the programmer as a directly invlolved partner.

      Personnaly, after 12 years online, I've seen many many things I could have
      copied, though I don't even have time to implement my owns and I have
      dozens on the back burner LOL :rolleyes:

    You can encode the PHP files with Ion Cube

    PHP Encoder, protection, installer and performance tools from ionCube: Home

    This prevents someone from directly copying the source code, although it doesn't stop someone from running an illegal copy of it.

    mywebwork: thanks, I'll check it out. Sounds good.

    DatingGenie: I'm confident my idea is not easily copied, because it will be hidden in the code and the WS members will not really know what is being done behind the scenes. That is why protecting the code is more important to me.

    You said in point 4: Get the complete documentation from the developer for each module rather than a whole chunk at the end.

    Could you expand on the reason for this suggestion please? I'm not sure why this is important enough for you to stress it.

    Hi inetmillionaire,

    I do understand your concern.

    The first thing you should do is look for a reputable company. Ask for references, samples and NDA. Good thing about company providers is they have a managers who will make sure the quality of the job. You can easily get in touch with them because you always have 2 -3 contact person. Your staff, the shift supervisor and the manager who will be handling your account and the staff assigned to work for your project.

    First, thanks for the info. I'm tempted to try smaller firms because it will be cheaper, but I guess I increase my risk for doing so. As a result, no account manager. I'm hoping with enough research I'll find the right person (I'm guessing there is enough talent here at WF or other freelancer sites).

    I have one question I was going to ask elsewhere, but I'll ask you first. Assuming I will use individuals for the projects, should I seperate the programming task of the system from the graphics/template of the site, or generally will one person be able to handle both? I want really good graphics and I'm willing to pay for it, but I need to know if my programmer will know how to use it - or do I get him to do the site graphics and the programming grunt work?

    That's why it's better to have a trusted and skilled coder who does every coding job for you. But to be honest, is wouldn't really bother too much about your design being copied - if the programmer isn't some cheap scumbag, he won't even think about it. Just check with who you're dealing first.

    I would ask them to (eletronically with Adobe?) sign a document that states that after they create the website full rights belong to you.
