You have to look at the specific psd you buy. There are different licensing rights for each one. I would say you typically do not have the right to resell there design. You will need resell rights.

Hello frenchsquared, I am not selling their "design". I am going to convert that design to a HTML or Wordpress theme, and then sell them.

That's like saying if I take a photograph of the Mona Lisa, it becomes my original work and it's not Leonardo's "design".

Check the license of the specific PSD, but usually if you want to do more than use it for your own site or one client site, you'll need to buy an extended license.

Yep... it is there design.
If you make a theme that looks exactly like mine, rather you create it from scratch or not you bet I will go after you.

The design is more then just the psd.

Just email then designer, I bet 90% of the time they would love the idea and give you permission.

I guess you didn't get what I asked. I won't be selling the design or PSD. I will be MAKING a Wordpress theme out of it and then sell it. That's my question.

The answer is no. You don't get what people are telling you.

1. You buy a psd
2. You convert psd to a wordpress theme
3. you sell the wordpress theme

Your selling the wordpress theme based on the original psd, something most resellers do not allow and is heavily frond upon. Buy a resell license then you dont need to worry.
