  • WEBSITE TERMS OF USE

This is such an important document for your online business for protection. Relying on free contracts and agreements is usually not the best choice.

A website terms of use govern a user's legal rights about the website and provide the website owner with control over their legal relationship with their users, visitors, and members. It should be well-drafted and contain the right DISCLAIMERS to protect you. This is your first line of defense should problems arise from customers or visitors. A terms of use a legally binding agreement and enforceable in a court of law.

These sample 5 pages will give you an idea of what a professional terms of service or terms of use agreement should look like:

    • I second this. Generic Terms Of Use would be like using a generic real estate contract. You can't use the same contract for buying a commercial property as you would for buying a house.

Every site is different just like every real estate transaction is different. Boiler plate contracts just don't work and if you ever have to defend one you will find this out the hard way, unfortunately.

All the big sites are changing their terms of service on a regular basis.

A perfect example of this is most people in the U.S. are told they need a will before they die. Most go the cheapest route possible to draft a will. They never bother to ask.... is there a better way.

The attorney who drafts the will for $99.00 does no estate planning (avoiding probate and limiting our taxes) and puts their will in his file draw. Most don't realize, file cabinets full of wills is the attorneys...RETIREMENT PLAN. Handling estates after death (probate) pays lots of money and takes very little paper shuffling (a 4 hr work week). Sports cars and big homes don't come cheap.

If the customer had paid a little more up front, they would have been instructed to put their stuff in trust and avoided probate all together. Cheap is not always the best.
