I've been meaning to ask this for a while now.

Is it legal for these CPA advertisers to use big name brands/trademarked terms on their landing pages and banner ads? For example:

Free [insert popular video game] and [insert popular game console]
Free Iphone with Iphone images
Free Ipad with Ipad images
Free Walmart/Target/Kmart giftcards with logos

Would my account get banned trying to upload one of their banners to a display network such as google's display network?

    Those advertisers have their asses covered when it comes to those trademarks... Generally speaking, banners that are provided by them usually have just enough fine print on them that you shouldn't have any issues because of the banner itself...

    What you will need to worry about when it comes to G display network is the destination you send your traffic to. 1st issue will be ensuring your destination gets approved, second will be that even after approval a review doesn't get you axed... and lastly, set up a matching "back up" offer to redirect to in the event that the primary offer you are using gets paused or taken down, as google will notice pretty quickly if your destination changes mid-campaign.

    I hope that helps- since your question was about the banners themselves. Banner wise, generally very little to worry about.
