About Selling Domain Names

Hi Everyone,

I would like to know a couple of things about selling domain names:

- How the domain is transferred to the new owner? Are there any fees involved in this process?

- Do one need to hold newly registered domains for any specific time before selling? I remember there is an option in Godaddy that says transfer locked, new registration... Not really sure what it is, is it related to selling and transferring to new owner?

- Is there any restriction to what (domain names) one can register? Trademarks are probably not allowed, right? And what about slight variations, like for example, Elance is there, can one safely register ALance, Blance, Clance etc and also what about different TLDs, like WarriorForum.com is here, can one register Warriorforum.net, org etc.

Would really appreciate your help!

      The exact process for transferring a domain name will vary slightly from registrar to registrar. I have found the easiest thing to do is to ask the new owner to open an account at your registrar. Typically, you can then just "push" the domain name to his new account. Then he can move it later if he wants. By doing this, no fee is usually charged.

      Holding periods are determined by ICANN. I believe you are required to hold a name for 60 days minimum from the last transfer or registration of the name.

      I don't believe there are restrictions on what you can register; however, you are right - it is not a good idea to register tradenames, product names, company names, or celebrity names, etc. When you do, you put yourself at risk of infringement and a possible law suit. You don't want to cause "confusion" between your name and the "official" company name or a personal name.

      Variations of names can be bothersome as well. Again, you don't want to confuse the public or consumers. I know this practice is done all the time, but I would suggest you stay away from it. There are much better and more professional ways to brand your business. You should really seek competent professional legal help when you have legal questions.
