[YOUR OPINION PLEASE...} Is it ethical...??

Hi fellow warriors,

I'm a graphic designers, specialized in mini site design and ecovers.

Often, I receive a special request from customers, asking for a SAME DESIGN as the one I've created in the past.

For example, take a look at this :

The client want EXACTLY the same design, just change the chemical tube and the site title and slogan.

Do you think it is ethical?

My first assumption would be NO! Because each design should be exclusive, right?
However, I really thought some of you might have different point of view about this, and I'd LOVE to hear that.

    Ethical, NO.

    Legal, probably - depending on your agreement with the other client.

    If the client is dead set on the same design, contact your other client and ask if it's ok to use their site as a template - they might be ok with it if it's in a different niche.

    Hey Oki,

    First off, nice designs!

    I would say it is not a big deal simply because if you change the tube, there really isn't much else in the design to make it unique.

    If he wanted the exact same design with the tube, I would tell him to contact the owner of the graphic and ask to buy the rights for it and then have you customize it for him, or even offer to do that for him.

    And to avoid this in the future you should clearly state in your contract/agreement whether or not you have the right to resell the design.

    Some people may be interested in a discount in the original design if you tell them you would like to retain resell rights to it, or pay a little extra for exclusive rights.

    No I think it would be unfair to the guy who paid , unless you told him others can buy it also before you sell to your buyer.
