Can someone confirm they allow Amazon associates in New York State?

I've just been affected by Amazon ending their associates program in California. I'm considering changing my address to one in New York. Just want to confirm that they allow New York residents. I checked the Operating Agreement and it seems to indicate that NY is ok, but I wanted to make sure.

Amazon is contesting the nexus state law in New York, but yes they are allowing affiliates. The company is paying the disputed sales tax into an escrow account until the suit is settled. You should perhaps consult an attorney and form an LLC in a state unaffected by nexus laws. That way, you won't even have to move.

Either way the suit is settled, associates in New York state should be ok, right?

I wouldn't count on it. The decision could go badly, and you could end up just like what Amazon has done in California and several other states. What I have done is formed an LLC in Delaware. It's expensive, but worth it considering the unsavory alternatives (ie moving from CA). Besides, 'tis the season to prepare for the holidays.

laws created in CA are like a cancer...they slowly infest the rest of the country. i've seen this first hand in the medical field. the legal system out there has been allowed to go to far in a variety of instances. beautiful place to visit, glad i don't live there.
