First Megaupload, next Fiverr?

I have to admit I didn't think of this myself. A commenter on my blog said, "I saw (AdSense click fraud) gigs like this on Fiverr and couldn't figure out why they are allowed! There are also a lot of pirating gigs on Fiverr too. I love Fiverr, but they better clean up their act. I don't want them to end up like MegaUpload!"

If I'm not mistaken (and I may well be), Megaupload was hit because it had at least one server in the U.S. and because the entertainment industry is on a tear about piracy. I believe Fiverr's servers are in Israel.

However, Google is fully capable of deindexing any site in the world if they suspect fraud. Look what they did to J.C. Penney for a time.

What do you think: Is Fiverr in danger and should it clean up its act?

    I don't think Fiverr is in any way in any kind of danger at all. Comparing the allegations from Megaupload with Fiverr is a stretch.

    And even if Google were to "deindex" Fiverr -- who cares? It just means they won't be found in Google's search results. As it stands, people know who and what Fiverr is and they would not suffer any decrease in traffic or business as a result of being taken out of Google's SERPs.

    I don't think they could get shut down. But Google can force PayPal to remove its payment processor service from fiverr - if fiverr admins don't do anything about it.

    The jump from Megaupload to fiverr is a bit of a big one. I doubt there's much to worry about. There's way too many sites that entirely exist because of piracy than fiverr is probably not even on the radar.

      As the old saying goes... 'You get what you pay for'. I'm not saying that there aren't some worthy giggs on there, but for $5 (Less after fee's), people aren't going to deliver great amounts.

      Maybe someone should launch 'Twentyy' for people to offer giggs that are more solid and worthwhile but for a bit more $.

      That's just my two cents anyway... I mean $5 :-)

      They're real fast about removing stuff when it's pointed out to them, but they should be proactive and put something in place to detect and remove it or not allow it to be listed in the first place.

      There's a lot of people selling pirated ebooks, but ebooks don't have the backing of the entertainment industry and law enforcement could really care less if people steal Internet Marketing ebooks. So it's not likely that they will even come into the feds radar.

      Fiverr needs to police it's own site if it wants to maintain any kind of decent reputation. Right now, it's becoming more like any other renegade black hat site. It's not just the piracy, but all the gigs like selling fake reviews, etc.

    You worry too much fLufF :-) There are many other websites like Megaupload, but only Megaupload got hit, because they did not have good lawyers and asset protection. I do not know how Fiverr handles their TOS, and legal agreements, but they are quite important these days.

    97% of what we worry about - never happens. So, taken easy :-)

        There is no security anymore. Any site is subject to immediate take down.

        Due to the multitude of fiat regulations, every citizen has broken at least four "laws" and is subject to prosecution and imprisonment. That's a fact.

      Megaupload is not the only filesharing site to get hit,As a result of megaupload getting hit many have closed their affiliate programs and are mass deleting all its files. More Will be hit soon.

      Totally agree. Fiverr need to kick all the fraudulent gig out (such as adsense fraud click service, etc), and ban the user who sell copyrighted thing.

    As long as there is money involved there will be both ethical and unethical marketers. I think we need to focus on how we can become ethical (not saying anyone here is unethical btw) and hope that sites will police their own.

    SOPA would knock out a good 3/4's of the internet (including fiverr) and it seems that got put on the back burner but that might well be just more smoke. I always try to ask what is the bigger picture? Does google care about fiverr? I am sure they are watching things like this at some level.

    megaupload is more content and less user interaction , hence an easy target for shutting down

    fiverr is more user interaction in terms of the gigs and hence piracy in terms of content is not a valid argument as was the case of megaupload...

    i am sure fiverr folks will be taking note, similar to what amazon did with the plr - kindle thing

      I'm sure. Thepiratebay is a thorn in a lot of peoples side.

      They have tried for years to take them down, but unsuccessful. All their servers are in Sweden, I think. They can't be touched, yet.

    This is beside Megaupload servers had the illegal downloads and it is not the case with fiverr, when someone selling you a pirated software, you are getting a link to it, and the pirated software probably on another sharing files websites.

      I think that one is for the lawyers. I am no lawyer but i believe the charges of Megauploads covers things like conspiracy and facilitation.

      I believe fiverr will be looking very closely at this and changing their ways as will many other sites.

      They will also be looking to the results (convictions if any) of MegaUploads.

      Anyone who hosts, links to, facilites or conspires to abuse copyright should be looking at this with wide eyes. Anyone who does not is simply burying their heads in the sand.

      Although I am completely against restrictions on the internet and I want it to be a great place to find information and to trade, the reality is that at some level it does need policing.

      Where that line should be drawn, of course, will be different depending on your views or position.

      Regardless of SOPA or any other "new" legislation there are still existing laws that most people operate by in the offline world so why should they not abide by them online.

      As for MegaUploads, well..........

      If you are getting picked on by everyone in the playground what do you do?

      You find one of the biggest stupidest bullies and sucker punch him right in front of everyone.

      Thats' what they've done with MegaUploads and they will now be expecting more respect and more than a few people to change their ways.

      Again with fiverr, Yes they do have gigs that sell pirated or illegal products. I don't think anyone can deny that.

      I doubt whether MegaUploads policy allowed it either. That is not the point. The point is that they allowed it to happen.
      In the real world if something illegal continuously takes place on your premises and you do nothing to stop it, it's a fair bet you will eventually be in trouble. Putting a sign saying" no drug dealing" is not going to hold much weight in front of the judge.

      But fiverr facilitate the illegal transactions regardless of where the goods are. AND take a cut of the proceeds (profiting from crime?).


      In my view they may be safe from prosecution currently but the expectation is that these "facilitators" should clean up their acts.


      And that must be better for business long term. I for one would like to be confident that I could go to fiverr and get exactly what I was promised and not have to worry about whether it's legit or not or that I might find a DMCA notice slapped on me.

    As far as I know, Fiverr is strict in accepting gigs. Maybe the commenter of Fluff's blog is just a spammer and just want to ruin Fiverr's reputation. I saw some traffic gigs that are adsense safe but I've never seen adsense clicks gig.

    Anyway, all web properties must be strict now. Not just Fiverr. All companies can be taken down if they violate rules!

    It's not a sharing website, no, but there are gigs offering $200+ software downloads for $5.

    Or there are plenty of people performing copyrighted songs in their videos...there is just a lot going on there that could be considered illegal.

    I like Fiverr and use it ALL the time, so I am not in favor of it shutting down by any means....but I think they should start to get more strict on listings.

        Definitely! I really like Fiverr, but some of the gigs should go down. Although Fiverr try to filter the gigs they should not be there, it seems that somehow it's not enough what they do.

    if you start creating a list... like a hit list... mega-upload first and so on... then I believe... Fiverr will rank somewhere after millions of those torrent websites... pirate forums... vague blogs (millions on blogspot itself)...

    next... megaupload was basically banned by FBI and Google had no role in it... they say (and they actually did) megaupload facilitated piracy... and yeah why not.. lets say i downloaded you WSO... and uploaded it on megaupload (or even rapid share, or filefactory) you will never know, but I can pass on the links or lets say resell it for 25% of the costs whats the big deal?... megaupload never profited from such transactions but only earned through traffic and ads...

    Funny though... reading the legal threats to ThePirateBay here... Its quite funny.. how lightly they take it...

      The accusations against Megaupload are quite different from anything I've heard Fiverr accused of. Although there are certainly individuals who use Fiverr as a conduit for infringement (as could happen with any such website), and those people should obviously be barred from using the site, I don't think Fiverr itself has anything to worry about, legally.

      What's even worse is that most of these "video testimonials" are done by college students who feel it is a great way of earning some quick cash.

      What they don't realize is that when they eventually go into the workforce, their credibility takes an instant hit once the companies screen the candidates. And we all know that corporations are increasingly looking into social media to know more about their candidates before hiring.

    No, I don't see Fiverr disappearing any time soon. Both are in different sides of the field, megaupload has been really a hot target ever since because of copyright issues of the files being uploaded to their site. I am not saying that there is nothing copyrighted in fiverr but I believe that their time is not yet coming.

    What I don't get is why ONLY MegaUpload?

    Surely EVERY file sharing website in the world should be shut down? No? (Well with servers in the States)

    You cannot tell me that there is a file sharing website with 100% legal file uploaded to it. DropBox is probably used to share files illegally... So is that to say DropBox is to be shut down?

    It's all getting a bit out of control... Next we'll see Warrior Forum getting shut down for quoting blog posts.

    Fiverr.com may become a lightning rod for over zealous prosecution if they don't get rid of the really egregious offensive gigs. Some of the gigs are just blatant theft. There's no defending them and the admins should clean shop asap.

    Interesting thread, I do think that fiverr has some issues they need to "manage" but the business model is very different than that "other" company that existed as a primary method of distributing pirated goods, (allegedly)

    Fiverr does need to consider the hand writing on the wall, as well as a lot of other organizations also need to "Police their own space"

    The one thing that we should all take away from this is that if a website does not take care of business, "Someone else will do it for you"

    I really think we will start to see compliance begin to go up among many websites online, including this one, the truth is that we know that there are certain business models that use deceptive advertising, they make promises they cannot keep, they make money hand over fist and leave many users in the lurch with a bad taste in their mouths, this leads to complaints, and then complaints lead to anger, and anger leads to reports to the FTC.

    I know this is unpopular, but we really have to deal with this issue because if we do not keep the place clean, someone else will do it and they will not really care about the good that happens in this industry, they will throw the baby out with the bathwater.

    To stop this kind of thing from getting out of hand we have to examine what is trash and what is a viable product.

    I don't know about fiverr but filesonic just screwed its affiliates and customers... I have a lifetime membership which just became worthless because of its recent changes (to avoid ending up like megaupload)

    If I'm not mistaken (and I may well be), Megaupload was hit because it had at least one server in the U.S. and because the entertainment industry is on a tear about piracy. I believe Fiverr's servers are in Israel.

    However, Google is fully capable of deindexing any site in the world if they suspect fraud. Look what they did to J.C. Penney for a time.

    What do you think: Is Fiverr in danger and should it clean up its act?

    But isn't there a difference between:

    A) Allowing users to share material that infringe copyrights on your website, and do nothing about it

    B) Not allowing users to share material that infringe copyrights on your website, but you haven't just 100 % control, 100 % control is very difficult, and so it will be always some materials that infringe copyrights

    If not, it would be very very hard and difficult to manage a web 2.0 website, like forums, or blogs where commenting is allowed.

    (You have to check properly every post's and comment's content, if they contain copyright infringing content or not, before you allow them. And I think doing this is very hard and difficult).

    Fiverr's thriving fake review gigs is what could get them in a jam. The FTC is cracking down and now there is a lot of media attention on the fake reviews (buying, bribing, etc)...

    That, along with some of the other shoddy stuff on Fiverr could spell trouble if they don't start cleaning up after themselves.

    Honestly, I don`t think that Fiverr is going to have a problem, They have a great reputation on the internet and that is what matters when it comes to keeping things around. Fiverr has great people on there supporting the work and actually doing the write thing. I am sure that fiverr will be fine because their reputation is so well.

    Yup — I'm a little confused as to why Fiverr is in question as well. If providers are scamming or pirating, the Fiverr ad should be indexed, and not Fiverr it's self. Much like any duplicate content penalty. And if it's a scam gig, the user community will leave feedback that reflects that.

    Even before this takedown of MegaUpload, I found Fiverr to be very accommodating about removing copyrighted material...as long as you can show them the evidence that you own the rights.
