Default how legal is this?

Ok seen a couple of sites saying things like this:
Since your product is downloaded after purchase no refunds will be given.
If you try to charge back rather than cancel, we will pass charge back fee back to you plus a "fine" of $50

is there any legal basis to sites being able to say that?

Thoughts?

I do not think that can be done. At least with my merchant accounts. My merchant accounts would kill me if I ever did that and the customer would just charge back again which would give me double fees.

Unless any applicable law or court of competent jurisdiction says otherwise, it
is "potentially" legal. But then, the bigger question is how to collect the fees.

As an FYI, various domain registrars charge higher than registration fees if its
users does a chargeback on their domain purchases and are eventually locked
out because of that. They're covered in their registration agreements, terms of
use, etc. unless any, again, court of competent jurisdiction voids any of them.

So far, though, I haven't seen any registrar's contract done away with for this
scenario.

Dunno about the legality but I can't see too many people wanting to have a business relationship under those conditions.

I certainly wouldn't buy. In fact, I'd run a mile from that kind of attitude.
