Okay, then you're tier 1 and they're tier 2.

Since Zango doesn't count as a tier, you're their front line, aka tier 1, aka 1st level affiliate, aka direct affiliate....

Are you sending them there as an affiliate? Or just a direct link to the tool bar without any credit to you?

If you are not Zango and you are sending people there to download the tool bar, then they are tier 2. You are tier 1.

So to answer your question, that's tier 2.
