Warrior Forum Terms of Use and Privacy Policy

Welcome to the Warrior Forum. Please review and accept these Terms of Use to access and participate in the forum.

To become a member of the Warrior Forum service you must read and accept all of the terms and conditions of this agreement. If you do not agree to be bound by the terms after you read this Agreement, you may not use the Warrior Forum service. Each time you access any part of the Warrior Forum, which is any page, file, or information found on the warriorforum.com domain or any subdomain, you are agreeing to separately be bound by the terms of this Agreement and any modifications.

Membership in the Warrior Forum can be just the forum and various subforums, or as a part of a broader package of services. Participation in the Warrior Forum or acceptance of this Agreement does not entitle you to other services or products included in other packages for which payment must be made.

For example, while the Warrior Forum gives you access to user forums for services such as Plug-in-Profit or Host4Profit, you must separately join and pay any required amounts to join those separate services. The same applies for the Warrior Pro service, and other services and packages which may periodically be offered.

The Warrior Forum generally consists of a number of forums and subforums. Some forums or subforums are not available to all members and may require additional payments or may only be offered to certain persons or which may be closed and not open to further members. Some forums or subforums may require a payment to make offers or posts.

You agree that we may modify the terms of this Agreement, in our sole discretion, by posting amended terms on this page. Additionally, the Warrior Forum is extremely active and events and circumstances can arise quickly which require rules to be posted for members that may not appear here but which appear in the forum. These are typically a 'Sticky' in the forum posted by the owner of the Warrior Forum (username 'Admin') or by one of the Warrior Forum moderators. These additional rules, and decisions by Admin or moderators are designed to be fluid and to ensure that the Warrior Forum provides a valuable service and is not abused. Your continued use of the service indicates your acceptance of the amended Terms of Service Agreement - either posted here or in the forum itself.

You agree that moderators are not paid by the Warrior Forum and are not employed by the Warrior Forum. They are independent contractors volunteering their time to ensure that the Warrior Forum provides a valuable service. You specifically agree that the Warrior Forum and its owner is not liable for any decisions made by the moderators and to waive any claims of liability.

You understand and agree to the following: (a) if you choose to register, you must submit a valid e-mail address and select a password and user name during the registration process; (b) You are responsible for maintaining the confidentiality of your member name and password, and all uses of your account - whether or not you've authorized such use; (c) You agree to notify the Warrior Forum immediately of any unauthorized use of your account; (d) You agree to provide accurate information and to maintain the accuracy of your information; and (e) You are at least 18 years of age.

Warrior Forum will not be held liable for any loss or damage for non-compliance. In addition, you understand and agree that the posts and user information of all users will be collected, aggregated and integrated into the Warrior Forum. You understand, and agree that the Warrior Forum in no way controls, verifies, or endorses any of the information contained on or in the Warrior Forum service, including links, product offers, Warrior Special Offers, emails, private messages, public messages, or forum posts.

Warrior Forum reserves the right to delete accounts created by users who appropriate the name, likeness, email address, or other personally identifiable information of another individual. Warrior Forum reserves the right to refuse the service, or any part of the service, to any user for any reason.

You may not create multiple usernames and accounts for the purpose of committing fraud, making misrepresentations, or to make posts by multiple usernames within the same forum thread.

You will not use the Warrior Forum to harass or abuse other members. Individuals who have harassed other individuals via message boards, private messages, classifieds, or using other means may be removed from Warrior Forum.

By registering you agree that the owner of the Warrior Forum may communicate with you via the private message and/or email system, and that this may include unsolicited offers or advertisements for products or services.

The Warrior Forum is not to be used by you for spam. You will not use the Warrior Forum to send via any format, and specifically private messages and email, any unsolicited offers or advertisements for any product or service. You will not use the Warrior Forum to collect names of persons to send via any format any unsolicited offers or advertisements for any product or service. If you violate this term you agree to pay the owner of the Warrior Forum $500 for every unsolicited offer or advertisement you send that uses the Warrior Forum private message system, or the Warrior Forum email system, within 30 days after receiving a demand for payment.

You are not authorized to use any content on the Warrior Forum outside of the Warrior Forum except where explicitly authorized. For example, forum posts are not to be copied or used outside of the Warrior Forum. If there is a subforum where users can post articles intended for distribution, then the use of those articles outside of the forum is permitted, subject to any restrictions placed by the author of the article.

You are fully responsible for any content you post on the Warrior Forum, including, but not limited to, photos, personal profile(s), private messages, email messages, and message posts - the consequences of any such content.

You understand and agree that Warrior Forum may review from time to time and delete any content that violates this Agreement or which might be inappropriate, offensive, illegal, or harm the safety of or violate the rights of any person. This includes any content that links to such improper content outside of the Warrior Forum.

Content that is illegal or prohibited, includes, but is not limited to, material, text, graphics, video or audio that:

• Is unlawful, harassing, libelous, abusive, threatening, harmful, bigoted, racially offensive, obscene or otherwise objectionable
• Displays sexually explicit material of any kind
• Is intended or designed to disrupt an ongoing conversation via flaming (a message in which the writer publicly attacks another participant in overly harsh, or personal terms) or trolling (deliberately posting derogatory or inflammatory comments in order to bait other users into responding).
• Encourages conduct that could constitute a criminal offense, gives rise to civil liability or otherwise violate any applicable local, state, national or international law or regulation
• Transmits or posts any unsolicited or unauthorized advertising, "spam," junk mail, "chain letters," "pyramid schemes," etc.
• Transmits or posts any content that infringes upon patents, trademarks, trade secrets, copyrights or other proprietary rights
• Transmits or posts any viruses or material designed to disrupt, limit or destroy any functionality of any computer software or hardware of users, members or the Warrior Forum
• Collects, stores or solicits information about other users or members for commercial or unlawful purposes or to engage in commercial activity such as contests, sweepstakes, etc. without Warrior Forum's prior consent
• Contains personally identifiable information about another member that is published without their express consent
• Contains material originally posted by another member that is reposted without permission or attribution
• Advertises any illegal services or the sale of any items prohibited or restricted by applicable law
• Has misleading email addresses or other manipulated identifiers to disguise its origin

Warrior Forum reserves the right to refuse membership to anyone. Warrior Forum may terminate your membership and any and all information, communications or postings, at any time, without notice, for conduct that violates this Agreement. No refunds will be provided.

DISCLAIMER OF WARRANTIES. YOU EXPRESSLY AGREE THAT USE OF THE SERVICES AND/OR ANY GRAPHICS OR OTHER CONTENT YOU DOWNLOAD FROM THE WARRIOR FORUM IS AT YOUR SOLE RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF FILES, SOFTWARE, SERVICES AND/OR ANY GRAPHICS OR OTHER CONTENT. THE SERVICES AND/OR ANY GRAPHICS OR OTHER CONTENT YOU DOWNLOAD FROM THE WARRIOR FORUM ARE PROVIDED ON AN "AS IS" BASIS. WARRIOR FORUM, ITS LICENSORS AND SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. NEITHER WARRIOR FORUM NOR ITS LICENSORS OR SUPPLIERS MAKE ANY WARRANTY THAT THE SOFTWARE, SERVICES AND/OR ANY GRAPHICS OR OTHER CONTENT YOU DOWNLOAD OR OBTAIN FROM THE WARRIOR FORUM WILL MEET YOUR REQUIREMENTS, OR THAT THE SOFTWARE OR SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES THE WARRIOR FORUM ITS LICENSORS OR SUPPLIERS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

THE WARRIOR FORUM DOES NOT REPRESENT OR GUARANTEE THAT YOU WILL MAKE A CERTAIN AMOUNT OF MONEY, OR ANY MONEY, OR NOT LOSE MONEY, AS A RESULT OF ANYTHING YOU LEARN OR OBTAIN VIA THE WARRIOR FORUM.

LIMITATION OF LIABILITY. IN NO EVENT SHALL THE WARRIOR FORUM, ITS LICENSORS OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE, AND/OR ANY GRAPHICS OR OTHER CONTENT, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, EVEN IF WARRIOR FORUM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER WARRIOR FORUM SHALL HAVE NO LIABILITY TO YOU OR OTHER THIRD PARTIES FOR ANY THIRD PARTY CONTENT UPLOADED ONTO OR DOWNLOADED FROM THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

INDEMNITY. YOU HEREBY AGREE, AT YOUR EXPENSE, TO INDEMNIFY, DEFEND AND HOLD WARRIOR FORUM HARMLESS FROM AND AGAINST ANY LOSS, COST, DAMAGES, LIABILITY, ATTORNEY'S FEES AND/OR EXPENSE ARISING OUT OF OR RELATING TO (A) THIRD PARTY CLAIMS, ACTIONS OR ALLEGATIONS OF INFRINGEMENT BASED ON INFORMATION, DATA OR CONTENT YOU SUBMITTED IN CONNECTION WITH THE SERVICE, (B) ANY FRAUD OR MANIPULATION, OR OTHER BREACH OF THIS AGREEMENT, BY YOU, OR (C) THIRD PARTY CLAIMS, ACTIONS OR ALLEGATIONS BROUGHT AGAINST WARRIOR FORUM ARISING OUT OF YOUR USE OF THE SERVICE OR SOFTWARE.

The Warrior Forum contains paid promotions. Information, including advertisement, placed by other members or the owner of the Warrior Forum may link to other locations for which the person is acting as an affiliate and thus may receive a payment or commission for the referral or if you buy a product from the referred merchant. They payment of a commission may affect which offers are posted. You are solely responsible for evaluating any offers and any similar products or services that might be available.

When you post information to the Warrior Forum, communicate with us, send us information, or provide content to us or provide any content (including but not limited to text, images, graphics, sounds, etc.) for use or display, privately or publicly on or through the Warrior Forum, you own your content. You own and are responsible for your words. However, you grant the Warrior Forum a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to exercise all copyright, moral, and publicity rights in the content, in any manner whatsoever, in any media or form now known or which may be created in the future, including in other works and forms not associated with Warrior Forum.

Warrior Forum allows others to add content to our services. Links may also be added to websites that are controlled by others. This is done automatically and without our review.

It is our policy to suspend or terminate the accounts of users who may intentionally or repeatedly infringe the copyrights others. Whether we choose to do so is entirely within our discretion.

If you believe that your material for which you own the copyright has been infringed upon or violated, please provide our Copyright Agent, in writing, with the following information:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.

4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

This Agreement in all respects shall be governed by and construed according to the laws of the State of Louisiana, to the exclusion of any other applicable body of governing law, without regard to conflicts of laws principles.

This Agreement is entered into in Calcasieu Parish, Louisiana. You consent to the exclusive jurisdiction of Louisiana for any dispute arising from or related to this Agreement.

You agree that the exclusive venue for any dispute arising from or related to this Agreement will be a court located in Calcasieu Parish, Louisiana.

Should any term of this Agreement be declared void or unenforceable, that term shall be severed from the Agreement and such declaration shall have no effect on the enforceability of the remaining terms.

Our failure to enforce any rights granted in this Agreement or to take action against any other party in the event of any breach shall not be deemed a waiver by us as to subsequent enforcement of rights or subsequent actions in the event of future breaches.

This Agreement constitutes the complete and exclusive understanding and agreement of the parties relating to the subject matter hereof and supersedes all prior understandings, proposals, agreements, negotiations, and discussions between the parties, whether written or oral. You understand and agree that you are solely responsible for reviewing the terms of this Agreement from time to time. Any continued use of the Software or Service by you after such amended terms have been posted or information regarding such amendment has been sent to you, shall be deemed your consent and agreement to such amended terms.
