Amazon Terminates California Associates

Just got this email from Amazon...

I guess the people of California will have to figure out another way to monetize the sites we already have...
Hello,
For well over a decade, the Amazon Associates Program has worked with thousands of California residents. Unfortunately, a potential new law that may be signed by Governor Brown compels us to terminate this program for California-based participants. It specifically imposes the collection of taxes from consumers on sales by online retailers - including but not limited to those referred by California-based marketing affiliates like you - even if those retailers have no physical presence in the state.

We oppose this bill because it is unconstitutional and counterproductive. It is supported by big-box retailers, most of which are based outside California, that seek to harm the affiliate advertising programs of their competitors. Similar legislation in other states has led to job and income losses, and little, if any, new tax revenue. We deeply regret that we must take this action.

As a result, we will terminate contracts with all California residents that are participants in the Amazon Associates Program as of the date (if any) that the California law becomes effective. We will send a follow-up notice to you confirming the termination date if the California law is enacted. In the event that the California law does not become effective before September 30, 2011, we withdraw this notice. As of the termination date, California residents will no longer receive advertising fees for sales referred to Amazon.com, Endless.com, MYHABIT.COM or SmallParts.com. Please be assured that all qualifying advertising fees earned on or before the termination date will be processed and paid in full in accordance with the regular payment schedule.

You are receiving this email because our records indicate that you are a resident of California. If you are not currently a resident of California, or if you are relocating to another state in the near future, you can manage the details of your Associates account here. And if you relocate to another state in the near future please contact us for reinstatement into the Amazon Associates Program.

To avoid confusion, we would like to clarify that this development will only impact our ability to offer the Associates Program to California residents and will not affect their ability to purchase from Amazon.com, Endless.com, MYHABIT.COM or SmallParts.com.

We have enjoyed working with you and other California-based participants in the Amazon Associates Program and, if this situation is rectified, would very much welcome the opportunity to re-open our Associates Program to California residents. We are also working on alternative ways to help California residents monetize their websites and we will be sure to contact you when these become available.

Regards,

The Amazon Associates Team

what are your thoughts?

any ideas on what to do with the sites you may have up?

I am sorry to hear that. Colorado a year ago and now California.

Although, I am not a big fan of amazon anymore, but what is going on causing a terrible damage to many people over there.

I am aware the biggest problem is the way they trying to enforce Amazon to work out on collecting tax which is not his job.

I think states need to figure out a way to handle the case with Amazon, I don't think Amazon is the looser in these associations, it is the people who making money out of Amazon, I remember how frustrating things went too in Colorado, their were people make living on Amazon, and one day it is all gone

From a sellers point of view, Amazon is a complete crap shoot. Their rules are corrupt and their Terms of Service is a complete joke. I really lost my patience bad with them a couple of years back. It pretty much resulted in my cursing out one of their employees. (oops.)

I really can't imagine how people actually put up with them. In my opinion, I think the way they have been operating recently could potentially drive them into the ground.

I just now read the email. I was actually going to build another site today but held off once I got word that Jerry Brown was to sign off on this.

This will have devastating effects on many business owners in California.

I've had Amazon sites for about a year but have not made any significant amount of $. I did, however, have a tiny flow of commissions and had the mindset to expand on my efforts.

    This is a bummer.

They also just terminated Illinois Associates earlier this year. I'm in Florida, and I know that Internet tax bills have been introduced, but no movement. I think it's just a matter of time.

With California being such a huge state, there must be tons of Affiliates losing that source of income.

I promoted about $800 worth of goods through their Associates Program this month. Still waiting on my $14 commission check from them.

All those in California who relied on that as their only source of income will have to find a new program to join such as Clickbank.

I think this brings it to 8 states that have been terminated, including mine (North Carolina). It took California being cut off for this to make national news, it seems (heard a report on NPR this morning) .

As you probably know, Amazon has now allowed affiliates from CA to rejoin. This is at least for a year, but maybe longer.

Here's the deal with Amazon and California:

Jerry Brown, son of a California Governor, Governor himself, as well as mayor of Oakland and California Attorney General after he was Governor, knows how to work the politics of a situation.

Amazon agreed to open processing facilities in California, then the Governor quietly repealed the "Amazon" law on a weekend when he signed a couple of other high profile laws. Part of the deal is that if there is no federal sales tax in place by 2013, Amazon will start collecting the California sales tax.

"Amazon will still have to collect sales tax in California in 2013 unless Congress intevenes before then."

Horrible. This taxation is getting ridiculous. I've had to switch my info also to avoid being terminated (I am in Illinois)

I saw that next year they go back into court. I am in California and most of my sites are for Amazon and about half of my 400 Keyword Domains to make Amazon sites with. I was even thinking about moving.

Amazon invited California Associates back on Oct 4. I was hoping that they would be able to take us back, but for some reason that day the email came I was not as excited as I thought. Just knowing that it may stop again, put a dim light on it.
