When you look at a Sales Page and you see the pictures of the people who sent in their own testimonials...what is the rule about this with regard to using MODELS over the jpg that they sent you?

    I'm not a lawyer. But I think it depends more on the model royalty/usage agreement than the contents of the testimonial.

    For example: at sxh.hu, they say you can use images of people for any purpose (their standard usage terms) EXCEPT as representations of other people.

    But either way, there's something seedy about using other people's pictures. I don't know what the legal issues are, but as a layman it definitely "feels" a little fraudulent.

      I would say use the ones they send you as the general reader would associate themselves with the common man's (or womans) pic rather than a model's long shiny haired fair skin acne free beautiful pic.

      It also depends on how you wish to run your business.

      Fake or genuine ?

      Choice is yours.

        It's a bad idea to put words to stock image photos of people. Many stock photo sites strictly forbid this practice. There is a big difference between someone's image smiling away in your header graphic versus their image being used as a testimonial attributing words to that image that the model hasn't signed off on.

        Do people do it? Yea, they do. People also rob banks. Doesn't mean you should...

        Take the high road.

      You might want to check FTC rules for testimonials and endorsements in marketing. Everything on their site is explained and I am pretty sure you can send in your own questions.

      As far as I know all the "Big Guys" that really care about their business don't play around with fake or semi-fake testimonials.

        Anyone can easily create testimonials and I don't know of a way to prove their accuracy, so I always skip the testimonials.

      If the "Big Guys" do it as you call them and they get found out, what do you think would happen to their reputation? Then what would happen to their sales? Pretty simple to figure this one out too.

        I agree. The big guys wouldn't be big guys if they did this regularly. It's pretty easy to call people out on the internet and it happens all the time. The "Big guys" are the savvy ones and are very careful.

    Don't! Have the people who give you testimonials either send you their own pictures, or don't use pictures. Pretty simple and easy to figure that one out. It's called being and staying honest.

    Ok Let's Say you have someone send in there photo, it's not suitable or there too young or you don't like the way they look, or its not the kind of Image you want seen with your product.

    Place's where you Buy photo's of Model's such as istock.

    You Haven't Actually bought the rights off the model, to put them in place of someone else for the testominal.

    you Can use photo's of Model's with the Right's to do what your saying, Depend's if youve been given the right's to thats all, & people Obviosuly just ignore it & do what they want anyway

    Just Clarify What Actual Right's you have when you get photo's of a Model, I know people who have just asked Friend's/Relatives/Family
    If they Can use there photo & Perhaps for a Testominal, ect.

    There Actually talking to the person whom's Photo of there using, so they would ask Can I use your photo? Will you let me do this with it?

    Alot of BH Marketer's .. Scrape/Steal Photo's from Dating Site's & Just Use & Abuse.

      video testimonials are hard to fake in terms of the owner of the product or website faking them, but actors could still be used to do this. Now it's easier than ever with websites like Fiverr.com. Skim through the front pages and you'll see many people offering not only written testimonials but video ones as well "I'll review and promote your product on video", "I'll talk about anything you want on video" for 5 bucks.

    What "big guys" are you referring to?

    There are plenty of issues here, though no one has mentioned problems from the person actually providing the testimonial.

    For example: I take the time to send you a testimonial and my picture. You decide I'm getting too bald and use Brad Pitt's photo instead. So now there is my name with my testimonial but a picture of someone else.

    Maybe I'm upset. Maybe I'm happy because now people think I look like Brad Pitt. I start to dream about hooking up with Angelina. Then someone complains I'm a fraud because I didn't use my picture.

    So I think, wait a second, you didn't get my permission to use another person's picture and to depict them as me -- and now my reputation is going downhill because people think I'm a fraud.

    Then the whole things goes viral and my business suffers due to all the fraud claims.

    Then, being an enterprising lawyer, I look into your authority to use Brad Pitt's picture.

    Getting more enterprising, I think about a class action lawsuit to recover the money paid by all your women customers who bought your product because of my studly picture.

    Then the FTC gets involved.

    The local DA sees a photo-op for his political campaign and talks criminal wire fraud charges. Brad Pitt is upset that the DA wants to take his deposition.

    Suddenly, TMZ and a horde of cheesy photographers are following your every move from your home until you're booked into jail.

    Your spouse leaves, taking the kids in disgust.

    And you think, maybe next time I'll just Photoshop that bald spot.
