BulkResponse.com - any opinions?

Hey WF,

I saw an ad for BulkResponse.com that allows customers to import existing email lists. I thought that was a violation of CAN SPAM law (there needs to be evidence of an opt-in)? I've emailed them for an answer but they haven't responded which is why I'm here.

Any views?

    "Needs to be" from whose perspective? Who's breaking that law (if it is a law) if there isn't? I don't think so, anyway. Even if that were so, that would presumably apply to BulkResponse's clients, rather than to BulkResponse themselves? (I'm not a lawyer!).

    If they allow people to do that, their deliverability-rate must surely be appallingly low (one would think)?

    Thanks Alexa. You're right there's more questions than answers with BR.com.

    My understanding of CAN SPAM is that the customer must make it clear they have opted in to your subscribers list (I could be wrong). That's why AW and Get Response offer the double opt-in - there's zero ambiguity.

    Here's Article 7 from the CAN SPAM act:

    "Monitor what others are doing on your behalf. The law makes clear that even if you hire another company to handle your email marketing, you can’t contract away your legal responsibility to comply with the law. Both the company whose product is promoted in the message and the company that actually sends the message may be held legally responsible."

    Now to address your questions
    There is a lot of misconception going on about CAN-SPAM law. Fact is, it legally allows you to make a first contact with your target audience, whether they have OPTIN for your offers or not.


    We encourage all our clients to strictly follow CAN SPAM FTC guide lines. You can view them on following link

    Bottom line, You have to take care of 4 things


    1. Don't use Fake names. You must use your real name or real Company name

    2. Don't use Deceptive Subject line. The subject line must be in connection with email body

    3. You must include your real physical address inside your message

    4. Provide Opt Out links and honor opt out requests


    There is no mention of Optin, Double Optin or Confirmed Optin in on the FTC website.


    Now lets come to email list import part.

    Law does not prohibit you to import your lists to a 3rd party service provider.

    Actually, All major bulk email services (mailchimp, aweber, icontact) allow you to import lists. We are different in a sense that we do not require re-optin



    Now to Alex's point on deliverability


    We do not share IP addresses. It means we give a dedicated IP address with good standing for every starting account. It is up to them to keep it clean and white-listed. In start, we give our clients IP address that is delivering in the inbox for all major services like Yahoo, AOL, Gmail.


    So every client starts with a good reputation, but if they mess around, and have lot of complaints, their delivery may decline. But clients who follow best email practices will continue to enjoy good delivery and mess created by other members will not affect them.
