Rights of an affiliate?

I am having a bit of trouble with an affiliate program and any help/advice would be appreciated.

I have been promoting a well known auto blogging software via the E-Junkie network.

The merchant was paying me fine up until september 09 when they seemed to just stop paying out.

My site cannot be used for any other affiliate programme because it has a similar name to the merchants product so i left the site running and continuing to earn affiliate sales.

Upto end december 2009 I am owed over $2300.

What are the rights of an affiliate in trying to claim this money?

    Did you sign an IO or terms? Small claims court would work fine.

    Hi Adsquare,

    Thanks for the reply, the help is much appreciated.

    I didn't sign anything with the merchant, their affiliate page basically told me the amount I would be paid, the date each month and a link to the e-junkie site.

    I will contact the merchant one final time before looking into a small claims court claim.

    America is not my home country (I am a UK based affiliate and the merchant is based in the USA) can small claims be done online?
