The Reasonable thing to do is to contact them first and ask them reasons for the delayed payment before saying all these.

Anything is possible but if you read the fine print in most networks TOS, it states pretty much that they can not pay you and they do not need to give a reason

/\ Exactly as Mr. Ba said.

I usually like to pay attention to TOS, just because it gives me a vague representation of what a company is all about. Sometimes I have found some very shady clauses in the terms of service, that make me realize a company is not really out for your best intentions (not just talking about CPA networks but certain businesses in general).

In fact, I think you can sue them, but I doubt the judge will even hear your case. I also have an idea what network you're talking about as I've seen quite a few complaints recently. My honest advice is get your money, than simply STOP USING THE NETWORK.

Really though. I've seen guys do this over and over and over complaining about a certain network, but then they keep using them. Right up untill the point the network doesn't pay at all. Then they complain about that too. "I'm out of 30g's" etc etc.

Lets be real, if you're seeing ANY sign of instability, and its persists for more than a couple months, I say PULL OUT. Its not worth risking. Still, so many people seem to just stay with networks till they sink, even when they had a good idea it was going to happen.

So can you sue them? Sure. Do I think it will do a single thing? No.

    G/luck!

I agree, you can sue anybody but winning that thing is a whole different ballgame.

Most cpa networks have pretty air tight terms of service which you agreed to when you joined them.

why would you create headache for your self. if they disagree to pay you then fair enough but for delaying your payment it would be waste of time and money from my point of view

Yes you can sue them if they break out the contract.

I'm sure you could find a lawyer to take your money yes. The thing most people don't realize is that networks have a lot of wording built into their TOS (you know, all those words you scrolled past and hit 'I accept' when signing up?) that give them the right to not pay you.

One of the big ones is that most networks have a clause wherein if they aren't paid by the advertiser, they don't have to pay you.

What's the reason for the late payment though? If they give you some reason about the advertiser, I would go to the advertiser directly and ask them if the network was paid (or on prepay). I've known a couple instances where a network told the affiliate they weren't going to get paid because the advertiser didn't pay them. When the affiliate went to the advertiser, they were given proof the network was paid for those leads.

Most of network say it in to their terms "Payment may be delayed up to 90 days".
How ever most of network above 50% claim to pay weekly. Payment depend on advertiser feed back. so little late is possible. Contact your network manager before any action.

Go and check, there are lot of terms and conditions applied in payment procedure. It's never an easy job to sue against any company and come up with win. I believe, you also know, you have to pay a lot to lawyer and finally you will lose!!

Which CPA network do you want to sue? If the network is familiar enough then you can't do anything suing them.
