Can a Trademark Owner Take My Domain?
Posted 26th March 2013 at 10:30 AM by kindsvater
Here is a scenario discussed at my legal forms site:
You have a domain and website. Later, someone comes along and trademarks your word. Can this trademark owner now take your domain?
No. This would only happen if you change your site to make use of their trademark.
Example:
You register acmezutts.com for your website which promotes acme zutts shoe insoles.
Four months later Jack trademarks the name acme zutts for selling automobile parts.
Although Jack now owns the trademark he cannot take your domain if there is a dispute.
Seven months later you decide to change your site to be about auto parts and put up AdSense ads.
Now you are trying to take advantage of the trademark Jack filed, and Jack could file a UDRP action to try and take your domain.
