Promoting to Purchased data it's Spam?

Hi im newbie and this is my problem,

im promoting cpa offers to a Purchased data,recently i started to receive some messages (three) from users that i send offers to them (people are so mad) some of them telling me that i'm spamming and they reported me to "legal team"....well because im newbie and not living in United States i didnt know about CAN SPAM according to wikipedia there is 3 basic types of compliance defined in the CAN-SPAM Act "unsubscribe, content and sending behavior compliance", luckily im respecting the two frist ones but im violating the act by using an SMTP for sending emails....so is that makes me a criminal ? can i get legal pursuit?

    Was the data 3rd party or scraped?

    If it is scraped, then it's not can-spam compliant.

    You should have purchased data cleaned by a reputable list hygiene company, to reduce the risk of known complainers, spam traps, etc...

    Sending using an smtp isn't a violation, unless you are using an smtp that isn't yours, without permission.

      its a third party data...for the smtp im using msft exchange !

    If you are using 3rd party data, then just remove the users that complained.

    3rd party data is can-spam compliant. But as you learned, it doesn't mean you can't get a spam complaint.

    However, if you are getting excessive complaints (after cleaning) and causing problems, then I would drop the source of the data and find better ones.
