DMCA Take Downs from Blogspot or Non Owned Sites

If I publish a original article to a blogger or blogspot site that I don't actually own, say Google does, eg http:// myblog .blogspot dot com (not real by the way) and that article is stolen in whole and placed onto a commercial site, can I do a DMCA take down for that other commercial site, or can only Google do it as they own the site. I am getting really fed up. When I use a generic gmail account and contact him asking about products he is selling as an affiliate, he replies within a day or two, but ignores me when I ask him politely to stop steeling my stuff.

I am actually thinking of ditching the blogspot and registering a domain similar, I now have many domains, but this was my first site and actually has a great following built up over the years. I feel like making a domain just to DMCA this idiot thief from India down.

Next question, say for example he is hosted with Hostgator, if I DMCA him, can he just re-host the site with Bluehost the next day and keep being a annoying peskie snake? :confused:

    If you wrote the article then you own the copyright

    Firstly, if you request a DMCA takedown with the host of a site, and they feel the same as you do, and take it down, can the owner of the "troubled" domain, just point it somewhere else and rehost the same stolen articles the next day with a new host?

    I would say you need to check your hosting provider term of service.

    Once you post an article somewhere, you are bounded with their roles.

    I believe you should be able to do so. You own the copyright to it after all.

    Ok, lets say the prick has a site with lots of stolen content on it and hosted with hostgator.
    The domains at Godaddy.
    I did a DMCA to Hostgator and they agreed with me and stopped hosting the site, (I believe they often close accounts so many sites may be effected).
    Could the thief the next day, just sign up with Bluehost, point his domain there and it would e the same result? In this case, I wouldn't bother. This is my consideration at the moment, I would love some feedback on.

    Would his domain get a black mark or something on it?
    Would he risk loosing his domain?

    No; you can do it because you own the content. Google owns the site: you own the content. It's the rights to the content that are relevant to serving a DMCA take-down notice on someone.

    You should do that anyway for a large number of other reasons (only some of them mentioned here), but this isn't actually one of them.

    Yes, but in reality it's extremely unlikely that he'd go to all the trouble/inconvenience/expense of doing so. Idiotic thieves like this usually just find someone else to steal from.
