My sexy new domain name - 007 Heaven!

No surprises, JamesBondSkyfall.com was taken! Sony Pictures grabbed it up!
But, I bought JamesBondSkyfall.us for a bargain basement price. Amazon products should fill the bill here (if I can work out how to decipher all their rules!).

The name is Bond ...... Warrior Bond! ;-)

Ignoring the obvious lawsuit issues David, how were you planning to monetize that site?

Good luck with that my man - I'm also sceptical but eager at that same time to see if you can pull this off - but I reckon sony will be after you as soon as the site goes live

The site was available for purchase - it looks legit to me. I am not using any logos or movie content that infringe on film copyright.

I guess you haven't heard the word "trademark". Domains are available for sale that violate trademarks. It's up to the purchaser to research terms for trademarks before registering. Sony can hit you with a cease and desist or file a UDRP to take the domain from you. They could also just sue you if they wanted to. Look up terms like cybersquatting and trademark infringement in Google. It will be an education.

You know there's lot of talk of trademark infringement in domain names however in most cases it only poses a risk.

This situation however is another kettle of fish given that the trademark owner has already registered the ".com" version.

Registering the same with only a different extension is really asking for trouble and it's very likely that you will be contacted.

You should apply for cancellation with immediate expiration otherwise you'll only have to surrender it months down the the line.

I know this from first and experience from naive choices I made myself years ago.

Wow, this is crazy.. You probably get a DMCA notice or a C&D soon enough.

I guess the only way to be around it is assuming your name is Actually "James Bond" other than that it won't be up for long

Oh, his hopes and dreams have now gone spiraling.

      So sad.

      What can he do?

Well, if he just purchased, and if he did it from godaddy, he can call them and see if he can drop it quickly.

Otherwise, it will need to sit until it expires.

Future suggestion - choose a name like "bestfamousspys.com" or something more generic.

You would have had a real heck of a time ranking your initial thought, and as mentioned the trademark issue.

To put it into quick perspective for you - if I were to register something like walmart.net - it makes me appear as though I am an approved walmart representative. Meanwhile, they have no control on what I do on my site. I could do something really stupid that endangers their brand name and costs them millions of dollars. You need to get permission when you want to use a product name in the domain.

I strongly advise you not to try to use it, David.

Not only does it seem that you've registered a domain-name which contains someone else's trademark, but unfortunately it's a "someone else" with a particularly litigous and aggressive reputation in such matters.

If you can't cancel/refund it, just chalk it up to "experience".

There are plenty of domains with trademarks available, but they're no use to anyone other than the trademark owner for any commercial purposes. That's why they're still available.

There are some purposes for which courts find it legitimate to use someone else's trademark in a domain-name, but they do tend to get tested in court sometimes (a lot of it's "precedent law") so this is for people with deep pockets. Those permitted uses also tend to exclude anything that involves financial gain/marketing.

Among the things that can and regularly do happen, when the trademark owner discovers such breaches of trademark, are:-
        • They can tell you take it down
        • They can take the domain from you
        • They can take from you any money you've ever made through the site
        • They can sue you for additional damages for flagrantly breaching their legal rights
Don't imagine that because "you're helping them to make sales" (as is often the case) they'll decide to be lenient. That isn't how it works.

The point is that owning a trademark effectively confers obligations as well as rights on the holder: when it comes to trademark renewal time, if it can be shown that they've knowingly failed to protect their rights with regard to the trademark, that can be held against them.

Some companies, for this reason, have the policy of pursuing all breaches of the trademark routinely and without reference to the motives/purposes/circumstances of the defendant.

I'm sure they will shut your site down AND take you to the court. You should change it before it's not too late.

If you purchased it from Godadddy within the last 3 days, call them and ask for a refund and cancellation. They're the only registrar that does this.
