    As for the legal questions, there's a "free legal advice" site where real lawyers will answer your questions for free. A simple Google search (for "free legal advice") will point you in the right direction.

    I'm pretty sure In their ToS you agreed to they are completely covered, like with most hosting companies (and companies In general).

    ALWAYS make backups! Even on some of my smaller sites I make backups.

    I'm sorry to hear about this. Holiday season Is one of the best times to make money and I feel for you.

    I would recommend you switch hosting, and stick to the "big names". I personally use Host Gator because I can host all of my sites at no extra charge.

    There's no legal action to take. Their TOS says you can't sue them (among other things).

    You really have to have your own backups in this world.

    sorry to hera this. But you should backup your sites yourself.

    You can go to court with them but I don't know if it is worthy.

    Next time try the best ones:

    liek Hostgator or Justhost.

    I'd start by suing yourself for not having a disaster recovery plan or backup plan.

    My latest no1 is to ensure that all hosts I use provide regular, offsite backups

    no2 is to ensure I have backups myself. No1 takes precedent as we all know how quick and easy it is to make changes to a site and not do the requisite backups.

    We've used Hostgator for over 5 years now and they seem to be one of the best.

    Definitely one of the most affordable when it comes to dedicated hosting.

    Wow, what bad timing.. sorry to hear that.

    I'm sure their TOS protect them in every way possible.

    I've used HostGator and BlueHost for years now with no issues... I tried TMD Hosting once and my sites got hacked every other day but they would at least revert them for me.
