A five-year-old boy has been billed for failing to attend a friend's birthday party - resulting in legal action.

Alex Nash, from Cornwall, was invited to the party just before Christmas.

An invoice for £15.95 was sent by his schoolfriend's mother Julie Lawrence, who said Alex's non-attendance left her out of pocket and his parents had her details to tell her he was not going.

Alex's father Derek said he had been told he would be taken to the small claims court for refusing to pay.

    Taking them to court is a little brash.

    What they did was completely gosh, however, it sounds like the cost of no-showing an RSVP was not explained in the invitation. The party thrower should have figured a few no-shows into their arrangements in the first place. If it was an issue that was going to hurt them if there were no shows, the importance of a no-show fee should have been explained. It's as easy as "there is a fee per head for the rental of the facility, so we would appreciate that cancellations be made in advance. They can't demand the fee as they didn't charge one to those who attended.

    Both parties were brash - but the complainant is totally out of line.

      It's OK, they're Cornish. Nothing to do with the rest of the UK. Different race altogether.

      This may actually be the catalyst the rest of the UK needed to realise they are in fact not the same as the rest of England.

        WOW! Did Polydore Vergil really write in English proper for the day? It is very similar to today, even if the spelling and proximity of words is different. Lodovigo described the cornish people much as one might describe THIS cornish family!

          The lawsuit is ridiculous. The kids probably won't be friends long, and just wait until the rest of the group knows about it. Totally stupid, although I agree the parents should have given notice.

          One birthday party I had at home outside for my older son when he was little, he wanted to invite all the boy classmates in kindergarten at the pre-school. Fortunately I had plenty of food, and every last one of those kids showed up...almost 30 boys. The mothers laughed every time another child showed up for the party and said how happy they were it was me and not them!

    O.k. so is that why the hen's are so tiny? I can buy em 2 or 3 in a package and they are real small, I guess suing over some stupid thing like that makes even the hen's shrink in to themselves

    INSANE!!!!!! You invite kids because they have some tie to yours. And NOW, you sue them for a 16 pound fee? And there WILL eventually be NO SHOWS! Maybe they were in an accident! Maybe he was punished! Maybe he got sick. WHO KNOWS! The notice could have been weeks, or SECONDS! Would a 5 minute advanced notice have made ANY difference?

    But a 16 pound charge is NOTHING! HOW does that even get to court?
