Okay, Need Your Help With Something

Okay so back in 2009, I canceled my Alltel cellphone service. They said I didn't owe anything after I paid the ETF (early termination fee) and all that good stuff, and this was in May of 09.

Okay so in like October of 09, I receive this collection's notice saying I owe $130.25. So of course I wrote back to them basically saying I don't owe the debt and to prove that I owe it.

It is now January of '10 and they sent me another thing saying "you have failed to pay or make satisfactory arrangements to pay the debt which we recently wrote you about".

Now now, I'm only 19 years old...BUT aren't they supposed to provide proof that I owe the debt? Isn't that a violation against the FDCPA law. Also I see that it's on my credit report now, so isn't that another violation? Oh and I still have the letter that I sent to them asking for the validation of the debt.

    Did you get anything from Alltell saying you had a zero balance after you paid the cancellation fee?
    If so, send them a copy of that certified mail along with a note telling them to cease and desist all collection actions.

      No I didn't. I canceled it over the phone and the woman said I shouldn't receive anything else. Like that account is gone now, so idk really what else to do.

    if you cancelled over the phone but paid the eary termination fee ( which is a rip off anyways) , you had to pay that fee someohow.. find the check or credit card statement where you paid it and send that to them.

    Judging from some of the phone 'support' I have received, the woman on the first call may have been mistaken from where she sits.

    If calls were made while the phone was active I don't see how any early termination fee would cover those calls.

    The early termination fee would in no way have any association with calls made on the phone prior to the termination.

    I would definitely ask to see the bill where those charges are... If they are prior to the ETF payment POSTING date and the numbers are recognized, you owe the money.

    If not, then you have proof of the date your ETF posted.

    (yes ETF is a ripoff in concept but usually tied to a discount rate associated with a contract - otherwise the rate would have been charged higher) and since that was more than likely mentioned you had the option to say no to the contract in front - and if not you accepted that agreement...

      I canceled it from my house phone so then wouldn't try to consider those minutes if I had called via my cellphone.

      And I just found an old bill with the etf stating that I owe nothing, so I'm all good now. Thank you both though.
