Pricing for Business Name Trademark/Patent?

Hey guys, local businessman here in NY asked me to help him get a patent or trademark for his new business name. I am seeing on Legal zoom this costs $600 plus fees.

Is there any cheaper safe way to get this done and also what would any of you charge the person to get this done for him please?

    First off charge him at least what your time is worth. You do not want to undervalue it. Second, you might be better off asking a Patent Attorney what they charge. That should help you establish a base price.

    I'm curious if any members have gone through the process and what it costs.

    LegalZoom and/or a patent attorney - is LEGAL advice from lawyers. If you are not a lawyer I don't think you should base your fees on what the pros charge.


    Have you applied for patents and registered trademarks in the past? Or are you planning to hire it done and serve as a middle man?

    You don't need a patent, you need a trademark.

    First, you need to do a trademark search to make sure the logo or name isn't already trademarked.

    Here is the link for that. A trademark search is free. The trademark may be a few hundred dollars.

    By the way, trademarking a business name is almost never necessary. A brand name is more likely to need a trademark. But the name has to be pretty unique. A name like Bob's Burgers is never going to pass. Way too common.

    An I don't mean to insult you, but you aren't the person to do this at all. There are trademark attorneys that will charge anywhere from $600-$2,000 to walk the client through the process. There is no reason for you to get involved.

    Why is he asking you, not a trademark/ patent attorney?



    If I were you, I'd do some research and tell my client the top 3 such attorneys and tell him to hire them directly. If they were not interested, I'd ask one such attorney what their fee is, what other costs they have, then add my fee on top of that.


    The only thing you'd be bringing to the table would be that it would be you who'd be dealing with the attorney and any hassles.



    You'd be scoring points with your client if you told him it's not something you're qualified to do and pass (or get hired to deal with whoever is qualified that they/you hire).


    You may be able to do it... It's not rocket science. But it's also easy to make a mistake. And if you do, you'd have to clean it up. And it would be stressful for you and, probably, cost you more than what you're going to charge.

    The basic cost to trademark a business name ranges from $225 to $600 per trademark class. The easiest and least expensive way to register your trademark is online through the USPTO's Trademark Electronic Application System (TEAS). The prices noted above are just for a basic trademark application assuming that you're not using a lawyer's assistance.

    However, given the complexity of trademark registration, it's best to hire a trademark lawyer. Of course this will increase the costs of trademarking the business name, but it really is worth it. I'd do some research on trademark lawyers in the area and compare their costs. Good luck!
