If someone steals an image from my site, and they insert it to there own site using the URL, not uploading it, does it count as a backlink to my site?

    Yes it does. In fact, this method is used when people want to build backlinks using things like infographics. They will provide embeddable code that others can paste into their websites to display the infogrpahic.

    Note that this sucks your bandwidth though.
