What do you do for email subscription proof?

Hi warriors,

I am getting back to email marketing after a long break and while I am working on things to generate traffic and bring in leads, I am also spending some thoughts on staying compliant under the data protection and privacy laws.

So, let's say you are collecting emails of visitors via your optin form, what do you do to prove that individual actually signed up, in case there's a complaint of some sort?

I'm thinking of collecting their IP address in addition to their email, so that if their ISP logs are reviewed in a complaint case, it can be seen that at that specific time, the individual with that IP address was actually on my site. I will disclose that I get their email + IP.

What are your thoughts?

    Isn't it enough just to use autoresponder and collect leads using optin form?
    Why you should get any complaint if person opted to your list by own.

    But maybe you could use double optin form, this way your subscriber would be hihger quality and would know for sure that he really want to be on your list so you won't receive any complaints.

    If you have double optin set up, you can prove that someone inside that persons mail account clicked on the confirmation email. That should be enough for most things.

    You surely are in the right direction. But would you be able to trace the real IPs of visitors who are using VPN. I think this can be a problem for you.

      Someone may enter their email, but unless you have proof of that, if they file a complaint when they receive an email from you, it may cause trouble. I mean, how will you prove you did not manually add that email address to your list?

      I am using an email marketing service (a popular one) and an optin form. But I am adding subscribers via API after they enter their email, which doesn't work like double optin. I may abandon API idea, just considering which will work best in a compliant way for me. I will investigate what the email marketing service stores as proof for double optin mechanism.

      Hadn't thought of VPNs and such. You have a point there.

      EDIT: I learned that I can send a confirmation email while using the API. So, I will store their IP, as well as send a confirmation email for the time being.

    If you are using an ESP, they will collect all the necessary info when the user subscribes.

    If you turn notifications on so that you get an email whenever someone subscribes, you should get a copy of all the data collected. Which will have more than needed if you are ever asked for an opt-in record due to a complaint.

    However, if you are generating opt-in subscribers, you really don't need to worry about it.
