Hello everyone I am what you might call a newbie to this forum.

I ran Copyscape for one of my website pages the other day and found somone had copied exactly, both, content and graphics from this page to one on their website.

My questions are

-What do most people do in this situation?
-Do you think Google penalise me for duplcate content ?

    What do most people do in this situation? File a DMCA on the site/host that stole your content.

    Do you think Google penalise me for duplcate content ? No, because the concept of "duplicate content" in this sense is largely a myth.

    Write them an email with lots of lawyer speak in it, copyright, trademarks etc and just give them a fright. Give them a time limit before legal action. Usually puts a spring in their step. Should be OK for duplicate content as long as you were indexed before him/her

      I believe in doing whatever it takes to get the job done.

      I send them the nicest email I can. 'They have accidently used your content. Easily done.' 'Sorry to have to do it. Yada, yada, yada.' 'Very sorry but could they remove it.' Blah blah blah. Be apologetic but clear that you want them to remove your content.

      Say you will contact them again in a few days if they 'have not got round to removing the content'.

      If they still have not removed the content send them a warning email. I'm in the UK and put at the top 'Notice: 7 days before legal action.' Tell them you will contact their hosting company who will close them down. This has always worked for me.

      Not pleasant, but I have found that being nice gets more done than telling them what I really think.

      I really don't want to have to take legal action because I have better things to do with my time. But I'm sure I will have to do so eventually.

    From what I have learned, you can do nothing in fact when someone steals your content online. You will have to prove many things, waste a lot of time and efforts, and in the end nothing will happen.

    Many people copy my articles online without my resource box; sometimes they even distort them, adding their own words. I tried to do something about this matter in the beginning, but after seeing what a mess the entire process was, I simply abandoned this matter.

    Google even puts stolen articles in the first page, even if they are badly re-written. Google cares only about links… So, don’t waste your time and efforts because in the end you’ll feel frustrated.

    One of my online friends saw someone copying all her interviews, and completely imitating her blog.

    There are so many similar cases… unfortunately there is no justice online.

    I don’t know if there are people who manage to do anything against those who copy their content.

    Everything should work differently. Whenever someone would be accused for copying content they should have their website locked until they could prove that they are the original authors of their website’s content. However, what happens in fact is that the real author has to suffer a lot trying to prove that he or she is the real owner of this content, without ever finding justice.

    Whenever I get some "new" plr, I always put the first paragraph into Google and do a search and inavariably I would find have a dozen or more websites carrying the very same article, word for word ! So what's with this duplicate content penalty ? And what exactly is this penalty ? Does anyone know ?

      quick thought ... sadly some would rather steal ideas and content especially from new blood.. its all part of the nasty business most of us would like to see cleaned up. ,, hint copy every thing you post anywhere to your hard-drive with dates and times... that will stand up in court if you must prove you have been plagiarized, and this forum will help as set forth in the TOS if you posted it here.

      Having your content stolen hurts. Especially when you've taken a lot of time to write it.

      Duplicate content however is a myth and will not affect you at all. The search engines will not penalise you. If websites could be penalized like that I would copy my main competitor's articles and pay a freelancer to paste them all over the internet and have their site banned.

      Here's I would approach this. Prepare an email and get a freelancer to look out for thieves. Tell the freelancer to inform the thief and follow up.

      That way you are hands free. Otherwise you have to consider if it's worth the time doing it yourself rather than improving your business.

    Are you running Wordpress? If so, try the WP CopyRightPro plugin. This disables all of the copy functions in your web browser. It is only a deterrent though.

    The irony here is that the autoblogging crowd does exactly the same thing. Most of them simply pull RSS feeds in and republish the articles verbatim.

    And they wonder why people don't like their business model? :rolleyes:

      So far, Internet is a great place for dishonest folks. The thing is, there's not much you can do. Focus your effort on your rankings - since the article is identical, only one of them should get listed. Make sure it's yours.

    Some plonker once did this to me lifting content of one of my adsense sites.

    I wrote them a note and they took it down.

    Funny thing was they never switched my adsense ads for their own so I actually made a few dollars

    I would certainly go for a DMCA complaint. There are lots of guys like those who think that they are smarter than everyone else and can copy without getting any injured by that.

    You could go for an email, but then they would copy some other site that doesn't really care or can't spot that they've been copied.

    It's very simple!

    Just find where the copycat's site is hosted by going through whois record of the site. Find who is the webhosting provider, you must find the real hosting provider not any reseller. Almost all recognised hosting providers have special email ids for such complaints. Just mail them proving that the content is indeed copied from your site. The hosting provider will take action. If no action is taken within a week, send them an email mentioning about legal cases and stuff. This time the hosting provider will surely take action; at least they will send an email to the copycat.

    This is the best method to go because you sending an email to the copycat will have little effect. If the web hosting provider sends an email with copyright violations, the guy will feel some heat and take away the copied content from his site.

    Send a DMCA to their host, including proof that your site was published first.

    And then, let it go. It sucks when someone copies your content, but it's going to happen - so don't waste your time and energy chasing down every instance of copied content when you could be focusing on promoting your own site.

    Plus, if they're simply copying and pasting content, chances are that their promotional strategy is pretty lazy as well, which means you'll still beat them in terms of rankings if you actively promote your site.

    did you create the content yourself? Or generate it with a tool? Or pay someone else?

    it's important because how you deal with it depends on what it cost.

      Hello,

      All of your content automatically has a copyright, whether you register it or not.. whether you indicate the copyright or not. However, it's always better to indicate and date your copyright ownership at the bottom of every page. You are protected online by the Digital Millenium Copyright Act.




      Here's what I suggest you do.
      • put a copyright on every pages by adding " Copyright (o) 2010 _____Your name. All rights reserved".
      • Also use copyright.gov. register in the United states even if your not from the united states.
      Email the offender, using the email address you use when registering in your domain/hosting company(the Thief and his ISP).
      Document your case that you own your (IP)Intellectual property and also give a deadline for removing the content, "after which point legal steps will be taken"(just to scare the hell out of them)...

      Steps below.
      • Send a stiff email to the thief (cc to the ISP). Be professional as the same time be aggressive. If the ISP finds the email written by an uneducated person it will go directly to the trash.
      • Also Send a gentle email to the ISP, letting them know that you have emailed their client and that they are subject to IP law.

        Webhost generally respect IP rights and will pull down the bad guys. Also, while they are not liable for a thief stealing your content, they can be held liable for keeping the website up. So they are not likely to risk legal complications for the sake of one website.
      The steps above usually solves almost 80% of the copyright problem. Sometimes not, specially if the thief's ISP is from a country that doesn't care about IP laws. You can do nothing else about this but wait for google/any other SE to find his website and delete it from their list.


      Always protect your content by copyright and remember that the thief will not achieve any success by stealing materials.
