Trouble getting a refund

I apologize to everyone because I just realized I posted this already in the wrong forum. To be honest, I'm not sure if this one is the right one either but I'm sure it's closer.

I'm hoping some of you smart people can help me with a problem.

In February, 2015, I joined a monthly membership program from an internet marketer (Not mentioning names) whom I had bought several products from previously. It was a good membership and I kept it. All of a sudden, I stopped getting the monthly content although I continued to be billed. As I mentioned, I had bought several products from this marketer and I trusted him. I waited a few months assuming there was a glitch somewhere.

When I continued to be billed for nothing I reached out to him through several support tickets and emails to every address I had for him. I got no response. I cancelled my PayPal subscription and continued to contact him.

He finally replied and seemed surprised and said he had ended the program months earlier and didn't know why I had been billed for so long.

I'm embarrassed to say that I paid for 19 months after the program ended. Mind you, I started to try to rectify the problem over a year ago.

At any rate, he refunded me four months worth or $71.88. That still leaves me with a $269.55 loss and he's stopped replying to me even after many attempts on my part. Aside from his support desk and various email addresses, I've messaged him through this forum and through Facebook. I sent him every monthly receipt.

What do you think? Do I have any recourse?

    Why wasting time messaging him repeately?

    Fill a dispute with paypal, and copy everything posted here.

    Claim your refund through paypal and they will investigate on your behalf.

      That won't do any good.

      At best, they might look back 45 or 60 days.

      I'm sorry, but this one is on you. You let it go that long and now you want your money back?

      Honestly, refunding your for 4 months is more than the seller really had to do. You easily could have, and should have cancelled the subscription long ago.

    I started asking as soon as I realized there was a problem. I've been pursuing this for over a year. He continued taking money from me long after he cancelled the program without letting me know. I'm not a lawyer, but that sounds a bit crooked to me.

      No idea why you let this go on for a year. If you were on automatic billing (charging your card) it should have stopped at the end of the program.

      I wonder what his side of the story would be?

        Claude Whitacre, his one and only message to me was that he didn't know why I continued to be billed and he'd look into it.

        And he's still selling the membership, by the way.

          So now you know - he's a crook. Plain and simple.

          You got ripped off by a fraud but you let it go too long as others have said.

          Move on with your life and business and as you do, take off the trust blinders. It's okay to trust people to a certain extent but not for months and months and months when it should be obvious something is rotten.

            Not necessarily, Mark. This very well could be a stocked continuity membership that begins with month one regardless of when one signs up. It very well could be, say, a 60-month drip fed membership that should've ended at month 60. A typo in the system or a forgotten entry in a box could cause the subscription charge to not end at the end of the membership.

            That said, I, personally, would refund the full 19 months if there's definitive proof that content was not received. I'd be pissed, though, that the customer let it go so long.

              I would have refunded the full 19 months as well. It could easily have been a glitch in the billing, as you said.
              In my opinion (The world always wants my opinion), it's such a small amount of money, I would have refunded it on the first e-mail. It's possible a staff person just ignored it.

              The Guru may not even have been aware of this continuous charge.

              But many companies have a rule that they will refund billed charges back 3 months, but not further. I assume it's because before that, the card company or Paypal can't refund the charge on its own.

              I had a client that I was billing $199 a month for several years. He called one day and said his business was closed 6 months ago. I refunded him 3 months. I was still promoting his business online, and had no idea he closed.


              On the other hand, the OP could have stopped the charge anytime.

      You've said this twice in this thread so what does it mean? You've cancelled the subscription payment over a year ago via Paypal but was still charged 19 more times/months?

    From my experience PayPal is excellent at correcting issued in favor on the person who was wronged. I expect they will be able to assist you.

      Unfortunately, no. Too much time has elapsed. This is simply a matter of one taking responsibility for their own actions, or lack thereof.

      Nineteen months? Seriously?? I check my PayPal and bank account daily for unauthorized activity. I think it takes all of one minute, combined. I'll bet the OP will start doing the same. If not, he deserves whatever he gets - or doesn't get.

    Wow, Optedin. The anonymous nature of the internet is really liberating, isn't it? I thought this forum was for mutual helping, not insults to someone you don't even know.

    I guess you didn't read my post carefully. I knew these payments were still occurring but I trusted the vendor. He's a very well-known marketer and I have purchased every product he released. We even emailed each other previously when I had a slight problem which he was quick to solve. I had no doubt that he would fix the problem. In truth, I believed that the content would still be mailed to me. I figured the site URL had changed and I just missed an email.

    I found the many months of content prior to his cancelling the program very useful and I hoped he'd carry on with it.

    And by the way, you check your PayPal and bank account daily? Amazing. Almost unbelievable.

    Yep, l agree with everyone here, you let it go for ages, so the vendor probably figured that you kept it going so you could go back to the material already there, or were still getting some worth from it?

    I have subscribed with several over the years, and after a few months the material gets thin, and other sections shut down, and members on their forums tend to disappear.

    But hanging on may also give you a gem, or two, or the vendor instead of hiding his best secrets, may finally cough up.


    But yeah, 1.5 years without occasionally checking to see if you still had access, (or were still paying) would be pretty easy.


    The vendor is probably thinking that you had access or used his material for over a year, and now want a refund for that, (which is pretty extreme, and probably won't happen).

    So, yeah, clock this up to experience and move on.
