Hello guys,
This is the first time I meet a scammer on the internet. Guess I trusted people too easily.

To make a long story short, I went to digital point and paid a guy $270 for a pr 6 domains, which of course he didn't give me. I got scammed for the first time on the internet. And it is also not the smallest amount of money, so I cannot let it go easy.

At first, having told from a friend that Paypal does not take responsibility for online goods, and because I had been cheated and I wanted my money back, I just claimed that it was not an authorized payment (I feel very sick that I have to lie to get justice), but with no success. I submitted it again, but they said it wans't a non-authorized payment.

So I called them and without telling them that it was an online good, I manged to get their help me and put a claim for item not received. Currently it's awaiting the seller's response.

I really need to get my money back.

Can anyone with experience please help me?

Thank you,
Isac

UPDATE 11/03/2011

I told the whole truth to Paypal, they seemed to be understanding.
The case is now pending final review.

I told them that at least they can't let this scammer keep on taking advantage of the Paypal system.

Will update on how it ends.

And from what it looks like many warriors are thinking that I'm trying to scam Paypal, but that is not the case anymore. I told them the whole truth and they seemed to understand.

Thanks again everyone for both criticism and encouragements. Good to see how many warriors want me to stay honest, proving that most warriors are honest people themselves. Also a lot of people told me that trying to lie is not a good choice, and that's why I told Paypal the truth.
WF is full of honest people, that is a great comfort to know.

So yeah, I thank you all for helping me make the right decision.

Paypal does not favor buyers or sellers, but they do persecute scammers and cheaters.

Even if I don't get my money back, I'll do everything possible to make sure this cheater can not go on and scam another person.

I hope this experience can be of help to all of us for future transactions.

p.s. I have all the chat logs and pms and I'm sure I can prove that the guy is a cheater if they ask me to, I even have a pm of him admitting to have cheated me and not wanting to refund.

Hopefully the truth will prevail.

Well, you already messed up, you aren't covered.

What you need to do is claim that you were trying to buy those PR 6 domains and you were supposed to receive a disk of information, and then you will be covered since it is a tangible item.

Shady, but if you want your money that is what you will have to do.

Yeah so I'm planning to say that it's like a tangible item, e.g. an ipod.
But do I have to show proof of a receipt or something? Or just me saying it is enough?

Unfortunately, this isn't going to do anything for your case. Just claiming that you purchased a physical item without providing proof won't get you very far. There is no reference to a physical shipment or purchase anywhere in your Paypal receipt information or the seller's logs, so Paypal is almost certainly not going to pay any attention to this claim of yours.

Is your Paypal connected to your credit card? If so, you can go directly to your credit card company and file a charge back. Otherwise your going to have to wait for Paypal to accept your charge back. If you know his name and address, you can go file a police report if he lives in the US and scare the jebus out of him.

That's the main problem. I had some funds in my paypal account so the money went from my paypal funds. Also looks like this guy lives in a foreign country very very far away from me. I'd really like to go and beat this guy up to death but yeah, that's not doable.

      Thanks for the help.
      Any more suggestions?

I don't think the scammer lives in US. I was scammed before trying to buy an ebook from someone from India. But that was only $7.00. But a loss is a loss. The second time I was scammed was about an alertpay to paypal exchange. That was $10 and was from the same country. Anyway, there are scammers everywhere if you are not cautious enough.

You probably can't get your money back. The purchaser will provide paypal with evidence that he was selling a website not physical goods (thus exposing you as a liar) at which point Paypal will lose interest.

You've, sadly, learnt a hard lesson. Which is - before parting with large amounts of money do your due diligence. Which includes researching payment methods and finding out that you should never use paypal when purchasing websites.

I feel for you - but lying isn't a good way to help your cause and get Paypal on your side.

Plus, you've just admitted to doing so in a very popular and very public forum - one that members of the paypal staff are probably reading right now!

Wait a minute! I sell domains as a sort of a sideline, (just because its fun).
I almost always use Pay Pal for anything under $1,000. (which is most of them). I go the long mile with my customers. Most of the time they verify that I actually own it thru whois because I INSIST THEY DO. (Most people have never heard of it.) The info on whois matches my office address and phone number. Anyone can verify my company listing through the Better Business Bureau. Even my cell is on there. The email address that I give goes to my computer not my assistant's. I've spent all kinds of time on the phone giving free advice on transferring domains, hosting, wordpress and everything else under the sun. Knock on wood, I've never had a problem with Pay Pal with domains or anything else. I've only sold two outside the U.S. (UK and Canada) but generally if it was over $1,000 and/or outside the U.S. I'd use Escrow.com

Yeah I understand what you are saying.... I don't like lying, but yeah I feel too angry for being scammed that I would like to do whatever I needed to make sure that the scammer doesn't get away with this, at least doesn't get away with my hard earned money...

I know that lying is not good, and I don't want to do it either

It's sad that Paypal won't defend for domains... I mean, I'm the one being scammed here (

Take a deep breath in and slowly breathe out...repeat this a couple of times and then

LET IT GO! - You wont get your money back! - Even if they accept your claim the buyer most likely already emptied his account (that happened to me) and then you will get nothing

Domains on DP are dropped domains anyway and lose their PR very quickly...

I can feel your pain (but that wont get you your money back)

the said thing is people who are reading this might get the impression its safe to sell something via paypal which is not the case either - (if the person used the creditcard to pay via paypal they can easily get the money back by doing a chargeback and there are a couple of threads here about this..)

At least report him/her on DP...and give us the paypal ID...

I know that lying is not good, and I don't want to do it either
Then stop lying. You know paypal does not guarantee any purchases that are digital and not physical products. That is nothing new.

You are angry with yourself because you made a bad decision. You bought from a site known for scammy offers, you didn't use a credit card for the purchase so no chargeback is possible. Many people here have made bad decisions at some time or other.

You made a costly mistake - so suck it up and learn the lesson. If you continue to file complaints at paypal trying to use different lies - you might endanger YOUR paypal account and damage yourself further.

That's not necessarily always the case, I personally have won cases for over $100+ as the purchaser, due to someone who was, well not providing the digital item that I paid for..

If you read the PayPal stance on the issue, they essentially cannot confirm that a purchase, was not delivered (because it's a digital good).. However, as PayPal reps have told me a few times, they do look into accounts, that have a lot of disputes.

My suggestion to you, is to go and call PayPal's fraud department, and let them know about the issue.

As well, in your dispute with PayPal for 'Items not received' send them a copy of the whois registration data (Whois.sc), and any contracts/messages you may have had with this person. The whois data would have changed to your name, if the person had tendered what you paid for.

Don't give up... But don't escalate the claim, unless a PayPal rep tells you to.

Let me ask a question here, if I may....

Is using a credit card the only way to protect yourself, as a buyer, in a PayPal transaction? I, too, was a victim of a scammer right here on the Warrior Forum - I bought a WSO and never received the download. The scammer has since been banned. One thing I learned was to never escalate the dispute to a claim with PayPal.

I read another thread here yesterday and it did give me some ideas .... the word "Fraud" has huge implications for the parties involved. When PayPal blindly sides with the scammer on a non-tangible goods transaction, they are, part and parcel, complicit in the fraudulent activity. I may dig into this aspect a little further and see what I can stir up....

What other payment gateways are being used successfully by other members??

Is there a way to retrieve the WSO that I got scammed from? It has been removed and I really could use it to battle my case with PayPal.

That really sucks. Hopefully you do get your money back. Keep trying. You have nothing to lose to try everything possible. But don't lie because it will come back to haunt you eventually.

Be careful when you buy domains from DP or anywhere else. You need to really make sure everything is as it should be before buying. Of course, it's impossible to know for sure but you can at least increase your odds by doing your due diligence.

I've bought 3 domains from DP and never had any problems. And all of them either retained their PR or actually increased in the next update. So you can get good ones on there if you are careful.

Yeah Tal that's what I'm hoping for as well. It really sucks that I have to waste my time and money because of other people being dishonest with me. But yeah again, I learnt the lesson, and looks like there are more bad people than what I imagined haha, especially on the Internet.

A friend of mine faced same issue, he paid $300 for adwords vouchers, the seller went offline once money was sent. A way out is to pay by credit card & if the seller plays dirty, you can play dirtiER.

I was once scammed for DP for a domain that was not transferrable in the first place. I made a complaint to PayPal and it was settled in my favour. However, the scammer had already taken most of the money out of his account and I was only able to recover a small proportion. I could have done chargeback with my credit card but I did not want to as PayPal could freeze my account in return.

For domain sales, websites and things of that nature, it's always best to use escrow.

    Escrow.com in particular.

Why? They oversee the transer, they track whois data, hold the buyer's funds until the buyer is satisfied then releases it to the seller.

Head over to escrow.com and give them a call, ask them how they handle sales of domains and websites. In the future, you should use them, it's likely one of the safest ways to go about buying a domain.

As far as your current situation, not really much you can do. You'll probably get your money back though because they tend to side with the buyer.

Based on what you've written I think it's time for you to
suck it up and move on. You've told so many lies to Pay Pal
I doubt there is any chance they'll do anything for you now.

Go make the money back some other way. The longer you
sit and worry and complain about it, the longer it will be before
you get back into a mental state that will allow you to earn
    more money.

You've enjoyed a nice pity fest... now get to work.

Everyone seems to think that paypal "does not guarantee digital goods" or whatever.... and that is a totally wrong premise.

    Let me explain:

Paypal will refund your money if you can prove that the digital good was NOT delivered. Digital good or not, the seller is still required to prove that he delivered the good in a dispute like this.

The confusion is that Paypal does not allow REFUNDS on digital goods. If the digital good was delivered, you cannot refund it.

This is totally different than if the guy didn't deliver it at all.

    Case in point:

I bought a "$7 ebook" one time from some guy that had a crappy landing page thrown up. Turns out his product was crap, but that is not why I filed a claim with paypal... I filed a dispute because the guy did NOT provide a link to download the ebook on the thankyou page... he simply put the text of the ebook directly on the thankyou page. There WAS no ebook, it was just a page of text.

Needless to say, I won the claim and my money was returned. I was able to prove that his sales page lied in saying I would be given an ebook.

This should tell you that Paypal DOES protect against false sales (digital or not).. but that they DO NOT allow refunds on digital goods that were actually delivered.. BIG DIFFERENCE.

In your case, you should have just told the truth and you would have been fine. You would have been able to prove that the domains were never transferred, and paypal would HAVE to give you a refund. If you take this stance now while the claim is being reviewed, you have a chance. Good luck. Also, your credit card company is a second option.

Not in my experience. Paid for a writer to write some content for my site, and articles didn't arrive. No contact at all from writer. Raised a paypal dispute, and only then she responded, said she'd already sent me the articles. Paypal said, "Oh, okay, she delivered, case closed". In that case, the seller's "proof" was "I already delivered". I did ask her to resend in case they'd got lost in cypberspace but writer was again AWOL.

Just because it is a domain, I don't think PayPal would let that guy take away your money. I know that they don't guarantee but they would still look into your case and see if you were really cheated. I've been scammed earlier for digital products and I manged to get refund without escalating the dispute.

Try to add more information to your case in the form of chat conversations between you and that guy or screen shots of his PM's. May be, you shouldn't have lied about the product first but don't let your hopes fall just because it is a digital product. PayPal wants to be in business and that's not gonna happen if they don't bother about scammers exploiting their system.

Doesn't Paypal block users/accounts, if they determine that an individual had indeed acted fraudulently? If so, then I don't see how it would make sense for the suspect in question to lose all ability to use Paypal for any future commerce over just $270.

Lying to Paypal about your purchase is a bad idea though, any way you look at it.

Send a paypal dispute immediately, that is the only way to get the money back. Make sure to do it before he withdraws it... You should of said half now and half later.

Well if you get your money back that would be a miracle to be honest. Had about the same 2 years back although the issue was about $50 instead of $270. I didn't got it back with help from PayPal since PayPal has some weird rules around digital products.

I was fed up, so I went to this friend that knows how to hack and such. I warned the seller that I had his IP address and would take means in to my own hands if he would not give the money back. I got my friend on stand-by, though he was not necessary because the threat alone did its work.

So what I am trying to say here is that if all is lost dear friend, you should perhaps choose a darker road. Or you can just take your loss and face it. It's not the end of the world, learn from it and become stronger.

    Regards,

    Steven

I buy sell websites every now and again, and all transactions have been through paypal. What other forms of payment are there for such things.

    Thank you,
    Isac

You're blaming PayPal for your own business blunder??? That's wrong... just as it is to be less than honest in presenting your case.

I'm experienced and my advice is to not blame others for your own mistakes. Certainly PayPal has no responsibility here... they were just facilitating a transaction you wanted to make. They have no reason to be involved getting back the money you allege was falsely taken. To get clarity on the matter, read the PayPal Terms of Service.

Use the charge back form on paypal.
But if you don't get good evidence, you will probably lose your money.

Okay - look - the squeeky wheel gets the grease with Paypal. They cover products and NOT SERVICES. That is their policy. So, hosting would not be covered - but if you did not get your item - they do have the power to ask the seller to refund the money and even make the judgement at some point.

When this happened to me over a domain hosting account that I no longer needed - I called in once a day to paypal and just kept re-telling the story. I also called the following:

The FBI Cyber Crimes Unit (just call tyhe FBI and ask them for the info)

The LOCAL BBB in the state I reside in AND the state of the company who took my money without service.

The company who took my money (once a day until I got a responce. Also emailed them daily)

The FTC - strike a complaint with them.

The Office of Attorney General (in my state)

When I emiled these companies - both paypal and the hosting company - they were able to return my money since I had pre-paid for a service that I was not getting.

Also call pay pal and ask to talk with a supervisor - see what they say. They will help you IF you talk to them correctly.

Will you get your money back - who knows but - the thing is - you have to make a stand. When I told them that I was a magician who held a worlds record for laying on a bed of nails - 283 hours and 5 minutes to break the world record - 11 and 1/2 days - After i assured them I had what it takes to see this to whatever level - they found the money and refunded it to me within a days. (Keep in mind it took almost a month for their investigations to catch up.)

All I can say is - try it and don't quit - it's like Internet Marketing.

    Yeah. Honesty prevails.

I called Paypal and told them the whole truth.

The case is now awaiting paypal's last review.

I'll be updating when I get the results.

    Thanks everyone.

    DO NOT LIE!

That will probably set off a red flag if you ever have disputes in the future. The best thing you can do is just explain to them as honestly as possible.

If he has had issues before than hopefully you will get refunded... not a fun experience to go through, but I feel that many people go through this at some point in their IM careers.

Also, don't listen to all the PayPal horror stories. They are very skewed and occasionally there is also a reason people end up in those situations. You wouldn't go looking for a way to tell everyone about how good your experience is with something.

But if you have a very negative experience, you'll probably blast out on a forum or look for places where you can post a negative experience.

That said, please don't lie and I hope you get your money back.

Well I think you are wrong here...

people should know the risks when doing business with paypal...

long time ago I bought a script from a site which turned out to be fake.
I opened a dispute, paypal acknowleged that claim and I got "my money back" which was 2,5 out of 200 or so.

The reason was that the vendor emptied his account all what was left was 2.5 (or so) - so please tell me that was my fault - that was a legit looking site which was selling scripts - I later found out that the programmer scammed hundreds if not thousand of people with those scripts...

And why was this thread moved to offtopic????????
