Tricky SEO question ...

A business partner and I have had a falling out. Long story short, I have a ton of blog content that Google has indexed on domain that my former partner owns. He removed the blog, and I have all the files (database, etc), but he is refusing to implement a redirect as he originally promised when we agreed to split up our partnership.
So Google has all the old pages / posts indexed. They are all dead links now.
Should I put up the content on my new domain now, or wait until Google de-indexes the original location first?
I'm worried that if I re-launch it now, Google may see it as a copy of the original, whereas if he implemented a 303, this wouldn't be an issue.
What a pain. Hoping someone can offer good advice.
Just got back from a #BrightonSEO. I was given room 404 in the hotel I stayed at. Couldnât find it anywhere!
