A Thief Stole My Product and Site And Is Selling Them As His Own

I try to think people are a decent bunch. But many times I am wrong.

I don't usually sell Wordpress themes I create on the internet. They are usually created for my clients to be used exclusively for their own sites. But I created some simple sales page themes for myself and a client who needed one. Then I had another client who asked for one and I gave him the one I created. Whoever I let use the themes loved them. And I found that they really worked well for me on my cpa sites. I was getting pretty good rankings.

So, I decided to create a site and sell them for what I thought was a good price so whoever wanted them could afford them. I sold them rather then gave them away because I wanted to make a little money and I had no links of my own in them like a lot of the free designs use. I even offered them here as a WSO.

The themes were selling pretty well from the site until I received a Dispute from Paypal because someone that bought the theme claimed that the sales copy on my site was misleading and didn't describe the themes properly. He wanted his money back.

Just by coincidence today, A friend of mine was looking in the Sitepoint Marketplace in the themes for sale section and came upon an ad for Wordpress Sales Letter Themes: Build a Sales Letter Website in a Matter of Minutes with Wordpress!! Just upload and edit.

He was curious and clicked onto the go to site link and he came upon my sales copy and theme but under a different website url: Wordpress Sales Page .

This is the exact site with the exact sales copy of my site. When you click the buy it now button the guy is selling it for more money also. He has stolen my whole site including copy and graphics and is trying to pass it off as his own. He is also using my Youtube video on his site. I am selling the themes for personal use without any resale rights whatsoever. The themes are labeled as such.

What really bugs me is that he bought my themes, is illegally selling my themes, using my exact sales copy to make sales and is trying to get his money back with a Paypal dispute from me too.

I have notified Paypal, his hosting provider:Hostgator and his domain host: Godaddy.

I am hoping that Paypal clears me in the dispute, but they always seem to side with the buyer no matter what.

I was creating more themes because I thought it could be a viable side business, but I have decided to rethink the plan and probably won't create any more themes in the future. I think this is a despicable situation.

    I have had this problem.

    k, I got really heavy on the guy, had my solicitor ring him and everything, if you are not that advanced pretend to get heavy. Make out like it's going to be jail for them, then when they reply (if they do, I was probably lucky) just tell them to completely rewrite the sale page and product in their own words and you dont' mind.

    I did this and ask him for 100% of his sales from my product and he paid me and completely rewrote the product so it's the same thing but totally different sales page and pdf, and to be honest he can get away with doing that, same idea, different content.

    You can't let it steal your focus, though. Stuff like this is going to happen. You do what you can and move on. Sounds like you've done as much as you can do at this point. It appears that they're from the UK, so lawsuits are probably not an option.

      I know someone in the US who had their whole site duplicated by someone in the UK (oddly enough) and against my advice to "just move on" the US guy contacted the person in the UK and he was actually man enough to confess that he did indeed steal the site and that he would have the site redesigned.

      I was shocked. Sometimes miracles do happen...

    Ok, here is my site that was copied

    At the start it was EXACTLY the same apart from the background, but now it's completely different, same formula maybe but very different.

    So here's how I would get them to change it...

    I would start with official looking emails that look like they are from a solicitor, you can always register a domain like abcsolicitors.com, make a webmail account and email them from there.

    If not letters, start sending letters if you can get there who is info, make it look like its from solicitors even if you dont have one, that should scare them.

    Apart from that there's not much you can do ( Apart from take em to court and that's going to be a massive hassle and not really worth it unless your site has a recognised brand name.

    A lawyer cost money, is it worth it to see if you might be able to find a guy in another country? Of course, this reality doesn't justify it and doesn't make it any less right.

    This is how you handle this:

    1) Contact his hosting company. Tell them what happened - and threaten that if they don't stop allowing him to use "copyrighted" material, you're going to drag them into it.
    2) Contact the guy and speak really "heavy" to him.
    3) Contact that guys payment processing company - clickbank, paypal or whatever - tell them he is illegally selling with copyrighted material - threaten that if they don't stop them - you're going to drag them into it.

    Oh yea, when you contact the guy - tell him what you are doing so he squirms. This should work for you. Tell me how it turns out...

    Try contacting the County Court in Derby and ask their advice. You may be able to initiate County Court proceedings and have the matter cleared up before you need to appear.

    You can also contact Derbyshire Constabulary and ask if they have an international fraud department to handle matters like this.

      Hi,

      No-one has suggested contacting sitepoint and informing them of the theft and asking them to take down the ad and possibly banning the user. I would do this, as well as the steps that you have already taken.

      As for paypal, it's not a dispute between you and the buyer. The problem you are highlighting is that they are using paypal to sell your stolen/copyrighted goods - this is a different scenario.

      As for impersonating a solicitor, or hiring a hitman, personally I wouldn't advise this :rolleyes:

    I found a letter template you can send to his web hosting company:
    DMCA Notice of Copyright Infringement - Sample Template - Digital Inspiration

    It looks like his hosting account is in the US, so I think US rather than UK law would apply here.

    You could then contact one of the solicitors (lawyers) on this page:

    and get them to send him a letter. Threatening to have him extradited to the US to stand trial for theft and copyright infringement should scare the c**p out of him.

    What a great thread, not for the fact someone is copying all of your hard work and making money from it, but the fact so many people are here to help you find a resolution.

    I think contacting hostgator and his payment processor and informing them of what is going on should do the trick, if not then try and scare him but using one of the above posts. Register a professional domain and act as a lawyer threatening legal action, if I was him I know what I would do.

    As for the paypal refund issue, yes 90% of the time paypal back the buyer but aslong as his website is taken down you can get on with your thing, don't let this effect your plans on a side business, these things happen but rise above it and come back stronger

    Somebody copied my ebook site a year or so ago and left my meta tags the same, even the title tag had my site name. He eventually took down the site, but not after a lot of back and forth emails about it.

    No need to contact him at all I don't think. Contact:

    - His hosting company
    - His payment processor
    - Anywhere that he is using to advertise or promote his services
    - His clients (ie post on the thread/forum on Sitepoint where he is making his offer)

    Inform them all repeatedly of the violation and hint at (or even threaten) legal action and one of those links in the chain is bound to break.

    Also, looking at this scumbag's copy site it seems he's taken the stuff down, so looks hopeful at least.

    Oh, and DO NOT let this discourage you from making more themes and expanding your business!! Are you kidding me? You are awesome for doing something like this in the first place... this is just the shit the happens sometimes, don't let it get you down!

    Hi Koolphoto,
    Just because this guy lives in the U.K. doesn't mean that you can't take action.
    Theft of anything (regardless of the fact it's in electronic format) is a criminal offence Worldwide! (i'm a former police detective so i know).
    In a nutshell, either visit your local Police Department & register the report with them to forward to the relevant UK police force (Derbyshire Constabulary). If they refuse to do that, then contact Derbyshire Constabulary directly via the internet. The chances are, most police forces will try not to take your report of this type of crime....as far as most officers see it, it's more of a civil matter. Let me assure you that although that is the case, it's also a criminal matter.
    Also, you may wish to report the website owner/designer to the police & Royal Mint for the miss-representation of a Sterling note, without prior authorisation, on his website. That too is a criminal offence (especially to display the Unique Identifier Number of the note) under Section 18, Forgery and Counterfeiting Act 1981.
    Hope that helps.
    Try to avoid any revenge tactics...i know it's hard to do but if you do go legal, there's always an audit trail that could unfavourably lead back to you.

    Looks like problem solved and you are also vindicated as many decent people came to your aid, I'm happy for that as I believe that for every jerk you can find many more decent men and women. (even cats )

    sorry you had to go through that hassle non the less.

      I received this email today from the person:

      "Domain has also been deleted. I am truly sorry for the inconvieniance this has caused you, I offer no excuses and you are right it is despicable and shows how desperate I was to do so. Times are hard but it doesnt excuse my behaviour. Also I would like to add that I am very sorry. "

      I hope he learned his lesson and doesn't try it again.

    Wow, I am actually surprised that he apologized. I have had copycats to some of my stuff also. I just keep working on new stuff and I don't let it slow me down and you shouldn't either.

    I would give him a chance to apologize for his 'mistake' - giving you the earnings, etc. Taking the site down...and you will give him the benefit of the doubt and not pursue matters with the police.

    Should he ignore you or tell you to buzz off - I would let him know that you are a well-funded entrepreuner, was doing this more as a hobby and intend to pursue matters regardless of cost until he is charged and punished appropriately.

    whether you intend to do that or not is besides the point...but give him evidence that you'll make his life a living hell - there's a chance he may decide that not giving in isn't worth it.

    Glad to be of any assistance & even more glad that he saw the error of his ways.
    I have always believed in giving most people a second chance but would always come down extremely hard on another who intentionally makes this sort of 'mistake' twice.

    Serve him with a DMCA notice.

    Send it to his hosting provider, e.g. Hostgator, - who must and will act - and to the offender.

    Here is an example:

    Notice served due to violation of one of your customers under the provisions of the Digital Millennium Copyright Act

    Pursuant to 17 USC 512(c)(3)(A), this communication serves as a statement that:

    1. I am [the exclusive rights holder for <enter details of material being violated> as posted on <enter URL of violating material>.
