That only applies if she was spidered first. Also, they may see him as the originator since he has more backlinks. If she was getting google love she would not be below him in the SERPS.

Plus, the one with the most backlinks is usually seen as the authority when the content is identical so he gets the credit for it and you are considered the "dup" from what you are...
